RESOLUTION AUTHORIZING A NINE MONTH LEASE AGREEMENT BY AND BETWEEN THE COUNTY OF PASSAIC AND 400 HAMBURG TURNPIKE, LLC., TO USE 20 PARKING SPACES FOR VEHICLE OVERFLOW AT THE PASSAIC COUNTY SHERIFF’S OFFICE HEADQUARTERS

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:12-4, the County may acquire any interest in any property; and
WHEREAS, the Passaic County Sheriff’s Office (hereinafter “PCSO”) seeks to enter into a lease agreement (attached hereto and made a part of this resolution) with 400 Hamburg Turnpike, LLC. (hereinafter “Hamburg”) to use 20 parking spaces located at 400 Hamburg Turnpike in Wayne, New Jersey, to use for overflow parking at the PCSO headquarters; and
WHEREAS, pursuant to the terms of the agreement the County will render payment of two thousand dollars ($2,000.00) per month to Hamburg, which will represent the cost of twenty (20) parking spaces at a rate of one hundred dollars ($100.00) per space, for the period of March 1, 2024, through December 1, 2024, for a total payment of eighteen thousand dollars ($18,000.00); and
WHEREAS, this matter was discussed by the Law and Public Safety Committee and is being recommended to the full Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-4, that the Board of County Commissioners of the County of Passaic authorizes the one-year lease agreement with 400 Hamburg Turnpike, LLC, pursuant to terms and conditions of the agreement, negotiated by the County.
LET IT BE FURTHER RESOLVED that the Clerk to the Board, County Administrator, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution, including executing a nine-month lease agreement with 400 Hamburg Turnpike, LLC.
