RESOLUTION TO INCREASE THE AMOUNT APPROPRIATED FOR CONTRACTORS WHO WERE QUALIFIED THROUGH RFQ-24-036: WEATHERIZATION ASSISTANCE PROGRAM RESIDENTIAL INSULATION AND VENTILATION REPAIR AND INSTALLATION WITH OTHER ENERGY CONSERVATION MEASURES, AND WHO WERE QUALIFED THROUGH RFQ-24-037: WEATHERIZATION ASSISTANCE PROGRAM RESIDENTIAL WINDOWS AND DOORS REPAIR AND INSTALLATION WITH OTHER ENERGY CONSERVATION MEASURES.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the County, through its Division of Weatherization and Home Energy (hereafter “Division”) of the Department of Senior Services administers various programs to reduce energy costs for low- income residents in Passaic County by improving energy efficiency; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-24-036: Weatherization Assistance Program (hereafter “WAP”) Residential Insulation and Ventilation Repair and Installation with other Energy Conservation Measures (hereafter “RFQ-24-036”), seeking qualifications for a pool of qualified contractors to provide professional weatherization remediation services consisting of insulation, ventilation, and related work activity for residents of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-24-037 WAP Residential Windows and Doors Repair and Installation with Other Energy Conservation Measures (hereafter “RFQ-24-037”), seeking qualifications for a pool of qualified contractors to provide professional weatherization remediation services consisting of windows, doors, and related work activity for residents of the County; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualification for RFQ-24-036 and RFQ-24-037 are publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, pursuant to Resolution R-23-1057, dated November 21, 2023, the Board authorized the qualification and award of contract to Divine Energy Solutions Inc. of Dover, NJ (through RFQ-24-036) and authorized the qualification and award of contract to C.A. Spinella, Inc. of Kinnelon, NJ and BGI Resources International Corp of Cherry Hill, NJ (through RFQ-24-037), all on a as-needed basis, for the period January 1, 2024 through December 31, 2024; with an appropriation amount of two hundred eighty and 00/100 ($280,000.00) dollars; and
WHEREAS, subsequently, the Division received the Low-Income Home Energy Assistance Program (hereafter “LIHEAP”) Weatherization 2024 grant and received a grant amendment increase for the Department of Energy (hereafter “DOE”) Weatherization 2023 Grant;
WHEREAS, the Division is requesting to add LIHEAP Weatherization 2024 funds in the amount of one hundred six thousand nine hundred forty five and 00/100 ($106,945.00) dollars and the DOE Weatherization 2023 grant funds in the amount of one hundred ninety eight thousand two hundred seventy six and 67/100 ($198,276.67) cents to the appropriation amount for the qualified vendors above, increasing the total appropriation amount for RFQ-24-036 and RFQ-24-037 to five hundred eighty five thousand two hundred twenty one and 67/100 ($585,221.67) cents; and
WHEREAS, funds are available in Account Nos. G-01-41-705-024-213 and G-01-41-708-023-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et.seq., vendors executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, certifying the vendors are not involved in prohibited activities in Russia and Belarus, and the County confirmed vendors are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the April 2, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED., that the Board authorizes an increase in Low Income Home Energy Program Weatherization 2024 funds in the amount one hundred six thousand nine hundred forty five and 00/100 ($106,945.00) dollars and the Department of Energy Weatherization 2023 grant funds in the amount of one hundred ninety eight thousand two hundred seventy six and 67/100 ($198,276.67) cents to the appropriation amount for the qualified vendors above, increasing the total appropriation amount for RFQ-24-036 and RFQ-24-037 to five hundred eighty five thousand two hundred twenty one and 67/100 ($585,221.67) cents; and
LET IT BE FURTHER RESOLVED, that the Director of the Board, the Clerk to the Board, County Counsel, Director to the Weatherization & Home Energy Division, and Purchasing Agent are authorized to execute an agreement.
