RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO JACK DONEHY COMPANIES, INC., TO REPAIR THE COUNTY-OWNED VACTOR TRUCK, PURSUANT TO N.J.S.A. 40A:11-5(1)(a)(ii)

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) are vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(1)(a)(ii), the County is permitted to award contracts outside of competitive bidding in excess of the bid threshold, for extraordinary unspecifiable services, provided that the County can satisfy the requirements promulgated by the Division of Local Government Services found under N.J.A.C. 5:334-2.1 et seq.; and
WHEREAS, the Supervisor of Roads is in need of parts and repair services to repair a County-owned vactor truck; and
WHEREAS, Jack Donehy Companies, Inc., provided a quote to the Supervisor of Roads to repair the County-owned vactor truck, in a total amount not to exceed fifty-three thousand three hundred thirty dollars and twenty-two cents ($53,330.22), which is being recommended for Board approval by the Supervisor of Roads; and
WHEREAS, Jack Doheny Companies, Inc., is the only vendor in Northern New Jersey identified by the County with the experience and ability to make the repairs on the County-owned vactor truck, because extensive training and specialized experience is necessary to repair vactor trucks; and
WHEREAS, it is not reasonable to use competitive bidding to procure these services because the only vendor identified by the County with the ability to draft the technical specifications needed to put this out to competitive bidding is Jack Doheny Companies, Inc., because in order to diagnose the repairs needed, it is necessary for an experienced mechanic to disassemble major portions of the vehicle; and
WHEREAS, pursuant to N.J.A.C. 5:34-2.3, the Purchasing Agent filed a Certification Declaration for Extraordinary Unspecifiable Service, attached hereto and included herewith, with the Board, explaining why it is necessary for the County to utilize the extraordinary unspecifiable services exception to procure these services; and
WHEREAS, funds are available in Account No. T-21-56-850-000-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the June 4, 2025 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5(1)(a)(ii), the Board of County Commissioners of the County of Passaic authorizes an award of contract to Jack Donehy Companies, Inc., in a total amount not to exceed fifty-three thousand three hundred thirty dollars and twenty-two cents ($53,330.22) to repair the County-owned vactor truck, as recommended by the Supervisor of Roads.
LET IT BE FURTHER RESOLVED, the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to the Jack Donehy Companies, Inc., and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
