RESOLUTION ADOPTING THE PRE-QUALIFICATION REGULATIONS FOR BIDDERS FOR THE U.S. CUSTOMS HOUSE (A.K.A. COURTHOUSE ANNEX) EXTERIOR RESTORATION PROJECT, PURSUANT TO N.J.S.A. 40A: 11-25

                     WHEREAS, the County of Passaic (hereafter “County”) owns and maintains the United States Customs House (also known as the Courthouse Annex), a historic site listed on the National and New Jersey Registers of Historic Places, and constructed in 1899 located in the City of Paterson; and

 

                     WHEREAS, in an order to preserve and protect the United States Customs House for future generations of Passaic County residents, the Passaic County Board of County Commissioners (hereafter “Board”) desires to undertake the U.S. Customs House Exterior Restoration Project (hereafter “Project”); and

 

                     WHEREAS, pursuant to N.J.S.A. 40A:11-25, the County is authorized to establish reasonable regulations appropriate for controlling the qualifications of prospective bidders upon contracts to be awarded by the County, which may fix qualifications according to factors set forth therein, including the experience of the bidders in the contract being procured; and

 

                     WHEREAS, the County desires to establish specific pre-qualification requirements for bidders regarding the contract for the Project; and

 

                     WHEREAS, additionally, N.J.S.A. 40A:11-25 requires the County to hold a public hearing prior to the adoption of any such regulations for prequalifying bidders for the Project; and

 

WHEREAS a public hearing was held on November 17, 2025, with notice of such hearing being published in The Herald News and Bergen Record; and

 

                     WHEREAS, the Director of Cultural and Historic Affairs is seeking authorization to adopt the pre-qualification requirements for the Project as set forth in the pre-qualification package prepared by Clarke Caton Hintz, P.C.; and 

 

                      WHEREAS, this matter was discussed at the January 28, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.

 

                      NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-25, the Passaic County Board of County Commissioners hereby adopts the pre-qualification requirements for the U.S. Customs House Exterior Restoration Project.

                     

                     LET IT BE FURTHER RESOLVED, that the Clerk to the Board is hereby authorized and directed to forward a certified and sealed copy of this resolution and a sealed Standard Certification form to the Director of the Division of Local Government Services for approval pursuant to N.J.S.A. 40A:11-25.

 

                     LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of Cultural & Historic Affairs, and Purchasing Agent are authorized to take all action necessary to carry out the purposes of this Resolution.
