RESOLUTION EXERCISING THE ONE-YEAR RENEWAL OPTION WITH THE FIREWOOD FARM INC. AND DTS TRUCKING, LLC, TO PROVIDE MULCH PRODUCTS FOR THE DEPARTMENT OF PARKS AND RECREATION, SB-25-026, PURSUANT TO N.J.S.A. 40A:11-4 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, on February 25, 2025, the Board approved Resolution No. R-25-155 authorizing an award of contract to The Firewood Farm Inc. and DTS Trucking, LLC, to provide mulch products for the Department of Parks & Recreation for a one-year term beginning May 1, 2025 and expiring April 30, 2026, with one (1) one-year option to renew in an amount not to exceed twenty-seven thousand five hundred dollars ($27,500.00) in compliance with N.J.S.A. 40A: 11-1 et seq.; and
WHEREAS, the Director of Parks & Recreation is recommending that a one-year option be exercised by the Board to renew the contract for the term beginning on May 1, 2026 and expiring on April 30, 2027, and an appropriation be made by an amount not to exceed twenty seven thousand dollars ($27,000.00) for purchases to be made on an as-needed basis; and
WHEREAS, funds are available in any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the January 28, 2026 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-1, et seq., that the Board of Commissioners of County of Passaic exercises its one (1) year option to The Firewood Farm Inc. and DTS Trucking, LLC, to provide mulch products for the Department of Parks & Recreation beginning on May 1, 2026 and expiring on April 30, 2027.
LET IT BE FURTHER RESOLVED, that the Chief Financial Officer is authorized to appropriate twenty seven thousand dollars ($27,000.00) for the purchase of mulch products, to be used on an as-need basis.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution
