RESOLUTION PROHIBITING THE USE OF MOTORIZED BICYCLES, MOTORIZED SCOOTERS, LOW-SPEED ELECTRIC BICYCLES, AND LOW-SPEED ELECTRIC SCOOTERS ON COUNTY PARK PROPERTY, PURSUANT TO N.J.S.A. 39:4-14.1, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the use of motorized bicycles, motorized scooters, low-speed electric bicycles, and low-speed electric scooters (collectively, “e-bikes and e-scooters”), as defined by N.J.S.A. 39:1-1, is governed by New Jersey traffic law, which permits counties to either permit or prohibit the use of e-bikes and e-scooters on certain types of county property, as set forth in N.J.S.A. 39:4-14.1, et seq.; and
WHEREAS, pursuant to N.J.S.A. 40:32-7.7, the Board operates and maintains numerous facilities within the County, including over sixteen thousand (16,000) acres of preserved open space and recreational facilities as part of the Passaic County Park System, through the Department of Parks and Recreation; and
WHEREAS, pursuant to N.J.S.A. 39:4-14.1, et seq., in the interest of protecting public safety, the County now desires to prohibit the use of e-bikes and e-scooters on all County property, including all Passaic County Parks, bicycle paths, trails, and on any sidewalk, footpath, pedestrian pathway, or other property under the maintenance and control of the County; and
WHEREAS, this matter was discussed at the May19, 2026, meeting of the Law and Public Safety Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:32-7.12, that the Board of County Commissioners of the County of Passaic, in the interest of public safety, hereby prohibits the use of motorized bicycles, motorized scooters, low-speed electric bicycles, and low-speed electric scooters (collectively, “e-bikes and e-scooters”), as defined by N.J.S.A. 39:1-1, on all County property, including all Passaic County Parks, bicycle paths, trails, and on any sidewalk, footpath, pedestrian pathway, or other property under the maintenance and control of the County.
LET IT BE FURTHER RESOLVED, that the Passaic County Parks Ordinance shall be amended to comply with the provisions set forth herein and pursuant to N.J.S.A. 39:1-1 et seq.
LET IT BE FURTHER RESOLVED, that the Director of the Department of Parks and Recreation is directed and authorized to place signage throughout the Passaic County Park System for the purpose of notifying visitors that e-bikes and e-scooters are prohibited on all County property, including all Passaic County Parks, bicycle paths, trails, and on any sidewalk, footpath, pedestrian pathway, or other property under the maintenance and control of the County.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of the Board, and Director of the Department of Parks and Recreation are authorized to take any action necessary to carry out the purpose of this Resolution.
