RESOLUTION AUTHORIZING COMPETITIVE CONTRACTING FOR PROFESSIONAL CONSTRUCTION ENGINEERING AND INSPECTION SERVICES FOR MORRIS CANAL GREENWAY PECKMAN RIVER CROSSING PEDESTRIAN BRIDGE NO 1600-625 IN THE TOWNSHIP OF LITTLE FALLS, PURSUANT TO N.J.S.A. 40A:11-4.1(i)

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and 

 

                     WHEREAS, N.J.S.A. 40A:11-4.1, et seq. authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and

 

                     WHEREAS, N.J.S.A. 40A:11-4.1(i) specifically allows the County to use competitive contracting for any service that is exempt from public bidding pursuant to [N.J.S.A. 40A:11-5]; and

 

                     WHEREAS, N.J.S.A. 40A:11-4.3 requires that the County pass a resolution authorizing the use of competitive contracting each time specialized goods or services enumerated in N.J.S.A. 40A:11-4.1 are desired to be contracted for the first time; and

 

                     WHEREAS, the Department desires to identify a consultant to provide construction engineering and inspection services to the County, specifically in relation to the construction of Morris Canal Greenway Peckman River Crossing Pedestrian Bridge No. 1600-625 in the Township of Little Falls, such consultant satisfying the requirements of N.J.S.A. 40A:11-4.1(i) because engineering consultant services are typically exempt from bidding pursuant to N.J.S.A. 40A:11-5; and

 

                     WHEREAS, this matter was discussed via email on July 13, 2026 by the Public Works Committee and is being recommended to the Board for approval;

 

                      NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1(i), the Board of County Commissioners of the County of Passaic is authorizing competitive contracting to retain a professional consultant to provide construction engineering and inspection services to the County, for the construction of Morris Canal Greenway Peckman River Crossing Pedestrian Bridge No. 1600-625 in the Township of Little Falls for the County of Passaic.  

 

                     LET IT BE FURTHER RESOLVED, that the Passaic County Purchasing Agent is authorized to take all necessary action to carry out the purpose of this resolution and initiate the competitive contracting process in compliance with N.J.S.A. 40A:11-1, et seq.

 

                     LET IT BE FURTHER RESOLVED, that the County Administrator, County Counsel, Clerk to the Board, and Chief Financial Officer for the County of Passaic are authorized to take all necessary action to carry out the purpose of this resolution.
