RESOLUTION REJECTING ALL RESPONSES RECEIVED UNDER RFP-26-015, RESPIRATORY THERAPY SERVICES FOR PREAKNESS HEALTHCARE CENTER, PURSUANT TO N.J.S.A. 40A:11-13.2(d)

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, Preakness Healthcare Center (“Preakness”) is a New Jersey Department of Health licensed, 406-bed skilled nursing facility that is owned and operated by the Board, and is in need of pharmaceutical services; and
WHEREAS, N.J.S.A. 40A:11-4.1, et seq. authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, on February 17, 2026, the Passaic County Purchasing Agent issued RFP-26-015, Respiratory Therapy Services for Preakness Healthcare Center (“RFP-26-015”), responses to which were received on March 10, 2026; and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(d), a contracting unit may reject all bids advertised in accordance with N.J.S.A. 40A:11-4.1, et seq., if the contracting unit wants to substantially revise the specifications for the goods and services; and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(d), the Executive Director of Preakness is recommending to reject all responses received under RFP-26-015, because Preakness wants to substantially revise the specifications for the goods and services advertised therein; and
WHEREAS, this matter was presented for the April 29, 2026 Health & Human Services Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-13.2(d), the Board of County Commissioners of the County of Passaic hereby rejects all bid responses received under RFP-26-015, Respiratory Therapy Services for Preakness Healthcare Center, to allow for Preakness to substantially revise the specifications for the goods and services advertised therein.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Executive Director of Preakness, Purchasing Agent, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
