RESOLUTION AUTHORIZING A REDUCTION OF THE CORRIDOR ENHANCEMENT FEE ASSOCIATED WITH PASSAIC COUNTY PLANNING BOARD APPLICATION SP-21-002 LOCATED AT 253 MARSHALL HILL ROAD, WEST MILFORD, NEW JERSEY FROM $9,508.00 TO $250.00.

WHEREAS, the Planning and Economic Development Department (hereafter “Department”) provides expert staff support to the Passaic County Planning Board (hereafter “PCPB”), Passaic County Board of County Commissioners (hereafter “Board”), County Agriculture Development Board, and Open Space Advisory Committee; and
WHEREAS, the Board is desirous of passing a Resolution authorizing the reduction of the Corridor Enhancement Fee (hereafter “Fee”) of $9,508.00 associated with PCPB Application SP-21-002 located at 253 Marshall Hill Road, in West Milford, New Jersey, for the Holy Institution Panagia Soumela (hereafter “Applicant”) as recommended by the PCPB; and
WHEREAS, by way of background, the Board reviewed the appeal of the Fee in letter format submitted by Haralambos V. Vasiliadis (President), (copy attached) on behalf of the Applicant for the site located at 253 Marshall Hill Road, West Milford, New Jersey (County Site Plan SP-21-002), which attests to the non-profit and religious use of the site; and
WHEREAS, in its appeal, the Applicant requested a waiver of the Fee since the Applicant is a tax-exempt, not-for-profit 501C3 charitable entity; and
WHEREAS, the PCPB and Engineering staff reviewed the appeal and the submitted tax-exempt certification; and
WHEREAS, the PCPB and Engineering staff recommendation was to reduce the Fee to $250.00 based on the not-for-profit and religious use of the site; and
WHEREAS, the PCPB staff’s recommendation was shared with the PCPB who voted on April 10, 2025 to recommend the reduction to the Board from the original assessment of $9,508.00 to $250.00; and
WHEREAS, the matter was reviewed and approved by the Planning and Economic Development Committee at its meeting of April 10, 2025, and is being recommended to the Board for approval; and
NOW THEREFORE, LET IT BE RESOLVED that the Passaic County Board of County Commissioners authorizes the reduction of the Corridor Enhancement Fee associated with Passaic County Planning Board application SP-21-002 located at 253 Marshall Hill Road in West Milford, New Jersey from the original assessment of $9,508.00 to $250.00; and
LET IT BE FURTHER RESOLVED the Clerk to the County Commissioners, County Counsel, and the Director of Planning are authorized to take any other steps necessary to carry out the purpose of this Resolution.
