RESOLUTION AUTHORIZING THE DEPARTMENT TO ACCEPT A DONATION OF STONE PRODUCTS FROM TILCON NEW YORK INC. OF PARSIPPANY, NEW JERSEY PURSUANT TO N.J.S.A. 40A:12-5.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and

 

WHEREAS, Tilcon New York Inc. of Parsippany, New Jersey (hereafter “Tilcon”) has offered to donate stone products to the Department of Parks & Recreation (hereafter “Department”); and

 

WHEREAS, the value of the stone products is approximately nine thousand three hundred forty four dollars ($9,344.00); and

 

WHEREAS, these stone products were mistakenly delivered to the Department by Tilcon and would cost more money to retrieve; and

 

WHEREAS, pursuant to N.J.S.A. 40A:12-5, the County is authorized to acquire personal property through gift and intends on using the stone products on County owned public spaces; and

 

                     WHEREAS, this matter was discussed at the March 26, 2025, meeting of the Public Works Committee, and is being recommended for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, that pursuant to N.J.S.A. 40A:12-5, the Board of County Commissioners of the County of Passaic hereby accept the donation from Tilcon New York Inc. of stone products approximately worth nine thousand three hundred forty-four dollars ($9,344.00) to be used on County owned properties.

 

                     LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are authorized to execute the contract and take any other steps necessary to carry out the purpose of this Resolution.
