RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION AWARD TO ATLANTIC TACTICAL INC., FOR THE PURCHASE OF NEW SMITH AND WESSON FIREARMS WITH MAGAZINES FOR THE PASSAIC COUNTY SHERIFF’S OFFICE, PURSUANT TO N.J.S.A. 40A:11-1

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (the “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on February 27, 2024, the Board passed Resolution No. R-24-193 authorizing an award of contract to Atlantic Tactical Inc., for the purchase of new Smith & Wesson Firearms with magazines, Streamlight Tier, Safariland Holsters, and Magazine Pouches, in the amount of two hundred fifteen thousand three dollars and five cents ($215,003.05); and in accordance with its response to N.J. State Contracts 17-FLEET-00732, 17 FLEET-00787, and 17 FLEET-00764; and
WHEREAS, the Passaic County Sheriff’s Office (“PCSO”) recommends an increase in appropriation to Atlantic Tactical Inc., N.J. State Contracts 17-FLEET-00732, 17 FLEET-00787, and 17 FLEET-00764, in the amount of eighty-six dollars ($86.00) to pay the remaining balance owed for the purchase of new Smith & Wesson Firearms with magazines, Streamlight Tier, Safariland Holsters, and Magazine Pouches; and
WHEREAS, this matter was discussed at the Law and Public Safety Committee on June 10, 2025, and is being recommended to the Board for approval; and
WHEREAS, funds are available in Account Nos., T-22-56-850-012-803, or any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2025 or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant N.J.S.A. 40A:11-1, the Board of County Commissioners of the County of Passaic is authorizing an increase in appropriation to Atlantic Tactical Inc., under N.J. State Contracts 17-FLEET-00732, 17 FLEET-00787, and 17 FLEET-00764, in the amount of eighty-six dollars ($86.00) to pay the remaining balance owed for the purchase of new Smith & Wesson Firearms with magazines, Streamlight Tier, Safariland Holsters, and Magazine Pouches, for a new total award amount of two hundred fifteen thousand eighty-nine dollars and five cents ($215,089.05).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
