RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO RER SUPPLY LLC, OF RIVERDALE, NEW JERSEY FOR VEGETATIVE DEBRIS REMOVAL THROUGHOUT THE PASSAIC COUNTY PARK SYSTEM PER SB-25-027, PURSUANT TO N.J.S.A. 40A:11-1, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic County Board of County Commissioners (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, pursuant to N.J.S.A. 40:32-7.7 the Board operates and maintains preserved open space and recreational facilities of the Passaic County Park System, through the Department of Parks and Recreation (hereafter “Department”); and
WHEREAS, on December 23, 2024, the Purchasing Agent issued Vegetative Debris Removal for the County of Passaic Parks and Recreation Department, SB-25-027 (hereafter “SB-25-027”), in compliance with N.J.S.A. 40A:11-4, et seq., seeking a vendor to provide vegetative debris removal services to the County; and
WHEREAS, the lowest responsible bidders to SB-25-027 were RER Supply, LLC and The Firewood Farm, Inc.; and
WHEREAS, the Director of Parks and Recreation is recommending an award of contract to RER Supply, LLC, for twenty-five thousand dollars ($25,000.00) for a one-year contract from April 1, 2025 through March 31, 2026 with a one-year option to renew; and
WHEREAS, the first year and option prices are as follows:
a. Category # 1: Cost per yard leaves $9.00; cost per yard brush $7.50; costs per yard wood chips $3.25; cost per grass clippings $16.80; cost per yard logs $10.00; cost per yard stumps $11.50; for a total cost of $58.05 per cubic yard
b. Category # 2: cost per 20-yard container $350.00; cost per 30-yard container $525.00 for logs/wood debris for a total cost of $875.00; and
WHEREAS, RER Supply, LLC, complied with the legal requirements as set forth under N.J.S.A. 40A:11-23 and the County is making the award of contract within sixty (60) days of the bid opening, as required under N.J.S.A. 40A:11-24(a); and
WHEREAS, funds are available in Account No. O-25-56-635-002-608 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed by the Public Works Committee on February 12, 2025, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, et seq. that Passaic County Board of County Commissioners authorizes an award of contract to RER Supply, LLC, as the lowest responsible bidder for the removal of vegetative debris throughout the Passaic County Park System for a period of one year with a one-year option to renew in an amount not to exceed twenty-five thousand dollars ($25,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of the Board, and Purchasing Agent are authorized to take any other steps necessary to carry out the purpose of this resolution.
