RESOLUTION CONCURRING WITH TOWNSHIP OF WAYNE ORDINANCE NO. 38-26 DATED JUNE 17, 2026, PURSUANT TO N.J.S.A. 40:20-1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic are vested with decision-making powers on behalf of the County; and
WHEREAS, the County is responsible for the maintenance Berdan Avenue in the Township of Wayne, which begins at Paterson-Hamburg Turnpike and ends at the Bergen County line; and
WHEREAS, the Township of Wayne has adopted Ordinance No. 38-26 dated June 17, 2026, attached hereto and made part hereof, revising the speed limit on Berdan Avenue from 45 miles per hour to 35 miles per hour; and
WHEREAS, the County Engineer is recommending that the Board concur with the decision of the Township of Wayne to adopt Ordinance No. 38-26 dated June 17, 2026; and
WHEREAS, this matter was discussed at the July 1, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1 et seq. that the Board of County Commissioners of the County of Passaic hereby concurs with Ordinance No. 38-26 dated June 17, 2026 adopted by the Township of Wayne; and
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of the Board are authorized and take any other steps necessary to carry out the purpose of this resolution.
