RESOLUTION EXERCISING THE FIRST ONE YEAR OPTION UNDER THE  CONTRACT WITH TRACK GROUP FOR GPS MONITORING FOR THE PASSAIC COUNTY HUMAN SERVICES DEPARTMENT AND THE PASSAIC COUNTY JAIL, RFP-24-002, PURSUANT TO N.J.S.A. 40A:11-4.1, ET SEQ.

WHEREAS, the County of Passaic (hereinafter the “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

                     WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereinafter the “Board”) is vested with managing the property, finances, and affairs of the County; and

 

                     WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and

 

                     WHEREAS, N.J.S.A. 40A:11-4.1(m) specifically authorizes the County to utilize competitive contracting to hire a vendor to perform consulting services; and

 

                     WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R-12-557 on July 17, 2012, authorizing competitive contracting for Continuous Electronic Monitoring Services; and

 

WHEREAS, thereafter the Purchasing Agent issued RFP-24-002 GPS Electronic Monitoring for the Passaic County Human Services Department and the Passaic County Jail (hereinafter “RFP-24-002”), responses which were opened on November 1, 2023; and

 

WHEREAS, on December 12, 2023, the Board passed Resolution No. R-23-1189, authorizing an award of contract to Track Group, Inc. under RFP-24-002 for a two (2) year period commencing January 1, 2024 and expiring December 31, 2025, with three (3) one-year options to renew, in the annual amount of twenty-five thousand dollars ($25,000.00); and

 

WHERAS, the Passaic County Sheriff’s Office is now recommending that the Board exercise the first one-year option under the contract with Track Group, Inc., for a term commencing January 1, 2026 and expiring December 31, 2026, in the annual amount not to exceed fifteen thousand dollars ($15,000.00); and

 

WHEREAS, funds are available in any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and

 

                     WHEREAS, this matter was discussed at the December 2, 2025 meeting of the Law and Public Safety Committee and is being recommended to the Board for approval; and

 

 NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1 et seq., the Board of County Commissioners of the County of Passaic hereby exercises the first one-year option under the contract with Track Group, Inc., under RFP-24-002, for a term commencing January 1, 2026 and expiring December 31, 2026, in an amount not to exceed fifteen thousand dollars ($15,000.00).

 

LET IT BE FURTHER RESOLVED, the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to Track Group, and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk to the Board.

 

                     LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
