RESOLUTION AUTHORIZING CHANGE ORDER NO. 4 TO NEW PRINCE CONCRETE CONSTRUCTION COMPANY FOR THE RECONSTRUCTION OF PATERSON HAMBURG TURNPIKE AND ALPS ROAD INTERSECTION IN THE TOWNSHIP OF WAYNE, PER BID C-21-019, PURSUANT TO N.J.A.C. 5:30-11.3

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, on February 8, 2022, the Board approved Resolution No. R-22-0093 awarding a contract to New Prince Concrete Construction for the Reconstruction of the Paterson Hamburg Turnpike and Alps Road Intersection, in the Township of Wayne (hereafter “Project”) with a contract award amount of five million four hundred forty thousand three hundred ninety-five dollars and eighty-four cents ($5,440,395.84); and
WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and
WHEREAS, in compliance with N.J.A.C. 5:30-11.3 et seq., the Board has approved the following change orders for the Project to date:

WHEREAS, the Passaic County Engineer is recommending that Change Order No. 4 be authorized for a net addition to the contract for the Project in an amount not to exceed one hundred seventeen thousand five hundred twelve dollars and fifty-eight cents ($117,512.58) due to field quantity adjustments for base contract pay items and the addition of supplemental items related to temporary traffic striping and markings for new signal head backplates, which will result in an increase of the original contract to six million two hundred seventy-four thousand seven hundred sixty dollars and fifty-two cents ($6,274,760.52); and
WHEREAS, the majority of the construction award is being funded by the New Jersey Department of Transportation County Aid 2019 and 2020 grants; and
WHEREAS, funds are available in Account No. G-01-45-700-021-911 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the February 14, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3, et seq., the Board of County Commissioners of the County of Passaic hereby approves Change Order No. 4, in an amount not to exceed one hundred seventeen thousand, five hundred twelve dollars and fifty-eight cents ($117,512.58) with a new total contract award in the amount of six million two hundred seventy-four thousand seven hundred sixty dollars and fifty-two cents ($6,274,760.52) to New Prince Concrete Construction Company for the Reconstruction of the Paterson Hamburg Turnpike and Alps Road Intersection, in the Township of Wayne, as recommended by the County Engineer.
LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with all of the general requirements for a change order as set forth in N.J.A.C. 5:30-11.3, et seq.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of Board of County Commissioners are authorized to execute an agreement, Change Order, NJDOT form, or take any other action necessary to carry out the purpose of this Resolution.
