RESOLUTION REAPPOINTING MEMBERS OF THE CONSTRUCTION BOARD OF APPEALS, PURSUANT TO N.J.A.C. 5:23A-1.3

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 52:27D-127, the Board established the Construction Board of Appeals to hear appeals from decisions made by construction and building code officials by citizens from those municipalities that did not establish same; and
WHEREAS, pursuant to N.J.A.C. 5:23A-1.3(a)-(b), the Construction Board of Appeals shall include five (5) regular members, with qualifications as follows: (1) Plumbing Subcode Official; (2) Electrical Subcode Official; (3) Registered Architect, or Licensed Professional Engineer with building construction experience, or other person qualified as a building subcode official; (4); Fire Protection Subcode Official; and (5) Fire Official; and
WHEREAS, pursuant to N.J.A.C. 5:23A-1.3(e), the Construction Board of Appeals shall also include two (2) special members, one of whom shall be a Licensed Professional Engineer and one of whom shall be a builder; and
WHEREAS, on April 27, 2021, the Board approved Resolution No. R20210408, reappointing the following members of the Construction Board of Appeals, with terms expiring on December 31, 2024: (1) Phillip Cheff as the Plumbing Subcode Official Member; (2) Robert Lynch as the Electrical Subcode Official Member; (3) Christopher Nash as the Professional Engineer Special Member; and (4) Dennis Kolano as the Professional Engineer Special Member Alternate; and
WHEREAS, on June 8, 2021, the Board approved Resolution No. 20210544 which amended Resolution No. R20210408 to appoint Dennis Kolano as the Building Subcode Official Member Alternate instead, for a term beginning retroactively on January 1, 2021 and expiring on December 31, 2024; and
WHEREAS, County Counsel is recommending that these members be reappointed for four (4) year terms, beginning retroactively on January 1, 2025 and expiring on December 31, 2028, in accordance with the law; and
WHEREAS, these reappointments were discussed at the January 15, 2025 Administration and Finance Committee meeting, and are being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:23A-1.3, the Board of County Commissioners of the County of Passaic authorizes the following reappointments to the Construction Board of Appeals:
1. Phillip Cheff as the Plumbing Subcode Official Member for a term beginning retroactively on January 1, 2025 and expiring on December 31, 2028.
2. Robert L. Lynch as the Electrical Subcode Official Member for a term beginning retroactively on January 1, 2025 and expiring on December 31, 2028.
3. Christopher Nash as the Professional Engineer Special Member for a term beginning retroactively on January 1, 2025 and expiring on December 31, 2028.
4. Dennis J. Kolano as the Building Subcode Official Member Alternate for a term beginning retroactively on January 1, 2025 and expiring on December 31, 2028.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board is hereby authorized and directed to send a certified copy of this Resolution to the New Jersey Department of Community Affairs, Division of Codes and Standards, Office of Regulatory Affairs, on behalf of the Chairperson of the Construction Board of Appeals, in accordance with N.J.A.C. 5:23A:1-3(h).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
