RESOLUTION CONSENTING TO A SHARED SERVICES AGREEMENT BETWEEN THE TOWNSHIP OF LITTLE FALLS AND THE COUNTY OF BERGEN, PURSUANT TO N.J.S.A. 40:41A-27(G)

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40:41A-27(g), any county that has adopted a charter pursuant to the Optional County Charter Law may not enter into an agreement to provide certain services or functions for a municipality located within another county, without first obtaining the consent of the board of county commissioners of such other county; and
WHEREAS, the County of Bergen (“Bergen County”), which has adopted a charter pursuant to the Optional County Charter Law, and the Township of Little Falls (“Little Falls”), desire to enter into the attached shared services agreement under which Bergen County will provide vehicle repair and maintenance services to Little Falls on an as-needed basis, and Bergen County and Little Falls have requested the County’s consent to such shared services agreement in compliance with N.J.S.A. 40:41A-27(g); and
WHEREAS, although all contracts governed by N.J.S.A. 40:41A-27(g) require that services must be performed on a cost basis, the County recognizes that Bergen County and Little Falls have reached a mutually agreeable arrangement under which Little Falls has agreed to compensate Bergen County at the rates set forth in the attached shared services agreement, which do not meet the requirements of N.J.S.A. 40:41A-27(g); and
WHEREAS, this matter was discussed at the September 30, 2026, Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:41A-27(g), the Board of County Commissioners of the County of Passaic consents to the attached shared services agreement between the County of Bergen and the Township of Little Falls, under which the County of Bergen will provide vehicle repair and maintenance services to the Township of Little Falls on an as-needed basis.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
