RESOLUTION AUTHORIZING CHANGE ORDER NO. 7 TO GRADE CONSTRUCTION FOR THE DECK REPLACEMENT OF THE JACKSON AVENUE BRIDGE No. 1600-026 AND REPAIRS TO THE PATERSON HAMBURG TURNPIKE BRIDGE No. 1600-029, PER BID C-21-004, PURSUANT TO N.J.A.C. 5:30-11.3 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, on November 23, 2021, the Board approved Resolution R20211085 awarding a contract to Grade Construction Inc. for the Deck Replacement of the Jackson Avenue Bridge over Pompton River #1600-026 on the Border of Wayne Township and Pequannock Township and Structure Repairs to the Paterson Hamburg Turnpike Bridge over the Pequannock River #1600-029 on the border of Bloomingdale and the Borough of Riverdale (hereafter “Project”) in the amount of four million one hundred sixty-eight thousand four hundred forty-two dollars and sixty-eight cents ($4,168,442.68), competitively bid under C-21-004 pursuant to N.J.S.A. 40A:11-4, et seq.; and
WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and
WHEREAS, in compliance with N.J.A.C. 5:30-11.3, et seq., the Board has approved the following change orders for the Project to date:

WHEREAS, the Passaic County Engineer is recommending that Change Order No. 7 be authorized for a net decrease to the contract for the Project in the amount of fifteen thousand six hundred sixty-six dollars and ninety-five cents ($15,666.95), due to additions and deletions of as-built quantities needed to complete the Project, which will result in decrease of the contract to four million two hundred fifty thousand two hundred fifty-two dollars and seven cents ($4,250,252.07); and
WHEREAS, funds are available in Account No. G-01-45-712-022-9B1 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, the majority of this project will be funded by the New Jersey Department of Transportation (hereafter “NJDOT”) Local Bridge Fund Grants; and
WHEREAS, this matter was discussed on June 9, 2025 by the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3, et seq., the Board of County Commissioners of the County of Passaic approves Change Order No. 7, in the decreased amount of fifteen thousand six hundred sixty-six dollars and ninety-five cents ($15,666.95), to Grade Construction for Deck Replacement of the Jackson Avenue Bridge over Pompton River #1600-026 on the Border of Wayne Township and Pequannock Township and Structure Repairs to the Paterson Hamburg Turnpike Bridge over the Pequannock River #1600-029, as recommended by the County Engineer for an updated total award amount as a result of the decrease not to exceed four million two hundred fifty thousand two hundred fifty-two dollars and seven cents ($4,250,252.07).
LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with all of the general requirements for change orders as set forth in N.J.A.C. 5:30-11.3, et seq.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of Board of County Commissioners are authorized to execute an agreement and Form SA-1 for NJDOT Change Orders and take any other action necessary to carry out the purpose of this Resolution.
