RESOLUTION EXERCISING THE FIRST ONE-YEAR OPTION TO RENEW CONTRACTS WITH PICERNO GIORDANO CONSTRUCTION, LLC, FOR PICNIC TABLES, PER BID SB-24-048 PURSUANT TO N.J.S.A. 40A:11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, on February 23, 2024, the Purchasing Agent issued Bid SB-24-048 Picnic Tables for Parks Department (hereafter “SB-24-048”) seeking sealed proposals from qualified bidders for the Picnic Tables for the Parks Department; and
WHEREAS, on May 20, 2024, the Purchasing Agent issued Bid No. SB-24-048, Picnic Tables for Parks Department (hereafter “SB-24-048”) seeking sealed proposals from qualified bidders for a period beginning on the award of the contract and expiring on May 31, 2025, with one (1) year option to renew the contract at the discretion of the Board; and
WHEREAS, on June 25, 2025, the Board passed R-24-571 awarding a contract to Picerno Giordano Construction, LLC, for a one-year contract beginning on June 25, 2024 and expiring on May 31, 2025 with one (1) year option to renew the contract at the discretion of the Board in the amount of forty-five thousand dollars ($45,000.00); and
WHEREAS, the Director of the Department of Parks and Recreation is recommending that the Board exercise the one-year option to renew contracts with Picerno Giordano Construction, LLC, under SB-24-048 for an amount not to exceed twenty-eight thousand one hundred dollars ($28,100.00) for the option term beginning on June 1, 2025 and expiring on May 31, 2026; and
WHEREAS, funds are available in Account No. 5-01-44-900-003-000 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 14, 2025 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, et seq, the Board of County Commissioners of the County of Passaic exercise the one-year option to renew contracts with Picerno Giordano Construction, LLC, under SB-24-048 for twenty-eight thousand one hundred dollars ($28,100.00), for the option term beginning on June 1, 2025 through May 31, 2026.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Board of County Commissioners, and Purchasing Agent are authorized to execute an agreement with the various vendors referenced herein, and take any other steps necessary to carry out the purpose of this Resolution.
