RESOLUTION QUALIFYING A POOL OF CONTRACTORS FOR ON-CALL PAINTING SERVICES FOR HISTORIC COUNTY SITES, FOR THE DEPARTMENT OF CULTURAL & HISTORIC AFFAIRS, PER BID SB-26-046, PURSUANT TO N.J.S.A. 40A:11-5 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold, shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on August 25, 2026, the Purchasing Agent issued SB-26-046, On-Call Internal and External Painting & Related Repairs for Historic Sites within the County of Passaic, (hereafter “SB-26-046”) seeking sealed proposals from qualified bidders for painting services for County historic sites, to be used on an as-needed basis; and
WHEREAS, on September 4, 2026, bids were unsealed for SB-26-046 by the Purchasing Agent with two (2) responses from qualified bidders received:
1. K & B Contractors, LLC
2. John O’Hara Company, Inc.; and
WHEREAS, the Director of the Department of Cultural & Historic Affairs is recommending that the Board qualify and authorize awards of contract to the above-named respondents, in accordance with their pricing submitted through SB-26-046 and attached hereto as Schedule A for a period beginning October 1, 2026 and expiring September 30, 2028; and
WHEREAS, the Director of the Department of Cultural & Historic Affairs is recommending that the Board authorize an appropriation in the amount of seventy-five thousand dollars ($75,000.00) for the contracts awarded under SB-26-046; and
WHEREAS, the Director of the Department of Cultural & Historic Affairs will assign work on an as needed basis, to the lowest responsible bidder for a specific assignment; and
WHEREAS, this awarded is being recommended as an open-end contract, pursuant to N.J.A.C. 5:30-11.10, and the Board is authorized to increase the appropriation amount under contracts bid pursuant to N.J.S.A. 40A:11-4; and
WHEREAS, funds are available in Account No. C-04-55-194-011-901, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 20266 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed on October 23, 2026 by the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4 that the Passaic County Board of County Commissioners authorize awards of contract to K&B Contractors, LLC and John O’Hara Company, Inc., for on-call painting services at historic County sites under SB-26-046, in accordance with their pricing attached hereto as Schedule A, for a period beginning October 1, 2026 and expiring September 30, 2028.
LET IT BE FURTHER RESOLVED, that the Board of County Commissioners of the County of Passaic hereby authorize the appropriation in the amount of seventy-five thousand dollars ($75,000.00) for the contracts awarded under SB-26-046.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of Board of County Commissioners are authorized to take any other action necessary to carry out the purpose of this Resolution.
