RESOLUTION AUTHORIZING THE PASSAIC COUNTY SHERIFF’S OFFICE TO DONATE ONE (1) HUNTER ENGINEERING COMPANY TIRE CHANGER TCX57 NO LONGER NEEDED FOR PUBLIC USE TO THE POLICE MOTORCYCLE OFFICERS TRAINING ASSOCIATION, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to Article VIII, Section III, Paragraph 2 of the New Jersey Constitution, counties are permitted to donate personal property no longer needed for the public use, provided that the gift serves a benefit to the community as a whole, and the recipient of the gift engages in roles related to the function of government; and
WHEREAS, the Passaic County Sheriff’s Office has identified a Hunter Engineering Company Tire Changer, Model#TCX57 that is no longer needed for public use by the Sheriff’s Office; and
WHEREAS, the Police Motorcycle Officers Training Association has made an inquiry regarding the availability of the Hunter Engineering Company Tire Changer, Model#TCX57; and
WHEREAS, the Passaic County Sheriff’s Office desires to donate said Hunter Engineering Company Tire Changer, Model#TCX57 to the Police Motorcycle Officers Training Association, as the donation of said vehicle will serve the community as a whole, and the recipient of the donation, as a non-profit organization with the purpose of training law enforcement officers, engages in roles related to the function of government; and
WHEREAS, this matter was discussed at the July 7, 2026 meeting of the Law and Public Safety Committee and is being recommended to the Board approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic hereby authorizes the donation of a Hunter Engineering Company Tire Changer, Model#TCX57, no longer needed for public use, to the Police Motorcycle Officers Training Association.
LET IT BE FURTHER RESOLVED, that the Passaic County Sheriff or his designee, Director of the Board of County Commissioners, County Administrator, County Counsel, Clerk of the Board, Chief Financial Officer, and any other employee for the County of Passaic may take any action necessary to effectuate the purpose of this Resolution.
