RESOLUTION QUALIFYING VENDORS AND AWARDING CONTRACTS FOR RFQ-26-046 LEAD ASSISTANCE PROGRAM: RESIDENTIAL LEAD REMEDIATION AND ABATEMENT SERVICES, AND RFQ-26-049 EXPAND POOL LEAD ASSISTANCE PROGRAM: RESIDENTIAL LEAD REMEDIATION AND ABATEMENT SERVICES, ON AN AS-NEEDED BASIS, BY THE DIVISION OF WEATHERIZATION, PURSUANT TO N.J.S.A. 40A:11-5, ET SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and

 

WHEREAS, the County, through its Division of Weatherization and Home Energy (hereafter “Division”) of the Department of Senior Services administers various programs to reduce energy costs for low-income residents in Passaic County by improving energy efficiency; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-26-046 Lead Assistance Program: Residential Lead Remediation and Abatement Services (hereafter “RFQ-26-046”), seeking qualifications for a pool of qualified contractors to provide professional residential lead remediation and abatement services for residents of the County; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-26-049 Expand Pool Lead Assistance Program: Residential Lead Remediation and Abatement Services (hereafter “RFQ-26-049”), seeking qualifications for a pool of qualified contractors to provide professional residential lead remediation and abatement services for residents of the County; and

 

WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualifications for RFQ-26-046 and RFQ-26-049 are publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and

 

WHEREAS, Pow/R/Save Inc. of Clifton, NJ, Optimum Environmental Solutions LLC of Union, NJ, Trinity Property Preservation of East Orange, NJ, and BGI Resources International Corp. of Cherry Hill, NJ, submitted proposals to RFQ-26-046 Lead Assistance Program: Residential Lead Remediation and Abatement Services, which were reviewed by the Evaluation and Review Committee and are being recommended for qualification by the Board to be used to provide residential lead remediation and abatement services for the Division;

 

WHEREAS, CPC Environmental Services Corp. of Newark, NJ and Artistic Building Trades LLC of Union, NJ, submitted proposals to RFQ-26-049 Expand Pool Lead Assistance Program: Residential Lead Remediation and Abatement Services for the Division, which were reviewed by the Evaluation and Review Committee and are being recommended for qualification by the Board; and

 

WHEREAS, the terms of the contracts awarded through both of these RFQs are January 1, 2026, through December 31, 2026; and

 

WHEREAS, the Director of the Division is requesting that the Board qualify and authorize an award of contract in an amount not to exceed One million two hundred thousand and 00/100 ($1,200,000.00) dollars to the vendors named above and be appropriated by the Board on an as-needed basis for the period January 1, 2026, through December 31, 2026; and

 

WHEREAS, funds are available in Account Nos. G-01-41-709-023-213 for the amount of $800,000.00, and G-01-41-709-024-213 for the amount of $400,000.00, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and

                     

WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendors executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and

 

                     WHEREAS, this matter was discussed at the December 2, 2025, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and

 

NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) is qualifying and awarding contracts to Pow/R/Save Inc. of Clifton, NJ, Optimum Environmental Solutions LLC of Union, NJ, Trinity Property Preservation of East Orange, NJ, and BGI Resources International Corp. of Cherry Hill, NJ, to provide residential lead remediation and abatement services under RFQ-26-046; is qualifying and awarding contracts to CPC Environmental Services Corp. of Newark, NJ and Artistic Building Trades LLC of Union, NJ to provide residential lead remediation and abatement services under RFQ-26-049, for the period January 1, 2026 through December 31, 2026.

 

LET IT BE FURTHER RESOLVED, that the Board is appropriating an amount not to exceed One million two hundred thousand and 00/100 ($1,200,000.00) dollars to be used on an as-needed basis for contracts entered into under RFQ-26-046 and RFQ-26-049 during the period January 1, 2026, through December 31, 2026.

 

LET IT BE FURTHER RESOLVED, that the Clerk to the Board shall print in the official newspaper a brief notice stating the nature, duration, service, and amount of the contracts to Pow/R/Save Inc. of Clifton, NJ, Optimum Environmental Solutions LLC of Union, NJ, Trinity Property Preservation of East Orange, NJ, BGI Resources International Corp. of Cherry Hill, NJ, CPC Environmental Services Corp. of Newark, NJ, and Artistic Building Trades LLC of Union, NJ and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board.

 

                     LET IT BE FURTHER RESOLVED, that the Director of the Board, the Clerk to the Board, County Counsel, Director to the Weatherization & Home Energy Division, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this Resolution.
