RESOLUTION APPROVING A SUBSTANTIAL AMENDMENT TO THE PASSAIC COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT FY 2019 ANNUAL ACTION PLAN AND UTILIZE FUNDS FROM FY 2019, 2020 AND 2021 TO FUND THE GARRET MOUNTAIN RESERVATION ADA IMPROVEMENTS PROJECT, AS AUTHORIZED BY 24 CFR SECTION 91.105.

WHEREAS, the Passaic County Board of County Commissioners (hereafter “Board”), on September 9, 2008, passed Resolution R-08-760 which adopted the Passaic County Citizen Participation Plan (hereafter “Plan”) under 24 CFR 91.105, for the Community Development Block Grant Program (hereafter “CDBG”); and
WHEREAS, the Board, on August 16, 2016 adopted Resolution R-2016-701 amending the Plan for the CDBG Program to comply with recent US Housing and Urban Development (hereafter “HUD”) regulations to include the Affirmatively Furthering Fair Housing Final Rule requirements found at 24 CFR 91.105 and 24 CFR 5; and
WHEREAS, the Plan was further amended by Resolution R-2017-0505 on July 12, 2017 to comply with added outreach requirements for Broadband access and emergency management supplemented to 24 CFR 91.105; and
WHEREAS, the Plan was further amended by Resolution R-2020-0438 on May 19, 2020 to incorporate language related to community access to program information and to permit public hearings to be held electronically in times of emergency as well as follow HUD guidance on shortened public review times during times of emergencies; and
WHEREAS, the Plan was further amended by Resolution R-2024-0194 on February 27, 2024, to incorporate language related to community access to program information and to permit public hearings to be held in person and electronically simultaneously, at the discretion of the County; and
WHEREAS, the Plan allows for a thirty (30) day period of review of the action to be taken by the Board on the substantial amendment to the Community Development Block Grant (hereafter “CDBG FY 2019”) CDBG FY 2019 Annual Action Plan to reprogram funding from CDBG FY 2019, 2020 and 2021 program years for the implementation of the Garret Mountain Reservation ADA Improvements Project; and
WHEREAS, the Passaic County Department of Planning and Economic Development (hereafter “Department”) has reviewed the scope of work for the Garret Mountain Reservation ADA Improvements Project and considers the project in the best interest of the residents of Passaic County and recommends the reprogramming of funds from CDBG FY 2019, 2020 and 2021; and
WHEREAS, funds are available in Account Nos. G-01-41-838-019-PE1, G-01-41-838-020-PE1 and G-01-41-838-021-PE1 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s); and
WHEREAS, the Department published an advertisement in newspapers of local circulation, The Record/Herald News, and El Especialito, note attached, announcing the proposed Substantial Amendment of the CDBG FY 2019 Annual Action Plan and the reprogramming of unobligated funding from CDBG FY 2019, 2020 and 2021 to fund the project for a thirty (30) day public review period between April 24, 2024 and May 23, 2024; and
WHEREAS, no comments on the proposed amendment were received from the public; and
WHEREAS, this matter was discussed at the County Commissioner Planning and Economic Development Committee meeting on May 29, 2024, and was recommended to the full Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to 24 CFR, Section 91.105, the Board of County Commissioners of the County of Passaic (hereinafter “Board”) hereby authorizes the Clerk to the Board and the Director of Economic Development to substantially amend the CDBG FY 2019 Annual Action Plan and reprogram funding from CDBG FY 2019, 2020 and 2021 to fund the project.
