RESOLUTION AUTHORIZING ENDORSEMENT OF PROPERTY OWNER CERTIFICATION FOR NJDEP PERMIT APPLICATION FOR THE NEW STREET RESERVOIR DRAINAGE IMPROVEMENT PROJECT AT GARRET MOUNTAIN RESERVATION, PURSUANT TO N.J.S.A. 40:20-1.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and

 

WHEREAS, the County of Passaic and PSE&G entered into an agreement dated January 7, 2025 concerning remediation activities and related obligations at and adjacent to Straight Street in the City of Paterson; and

 

WHEREAS, PSE&G has completed site remediation work at the referenced location and requires submission of a Remedial Action Permit Application to close out the remediation; and

 

WHEREAS, the County Engineer recommends approval of the endorsement and related authorizations; and

 

WHEREAS, this matter was discussed at the April 15, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.

 

                     NOW, THEREFORE, LET IT BE RESOLVED, that pursuant to N.J.S.A. 40:20-1, the Board of Commissioners authorizes the Commissioner Director to endorse the Remedial Action Permit Application on behalf of the County of Passaic for PSE&G’s remediation on Straight Street in Paterson.

 

                     LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are hereby authorized to execute the agreements and take any other steps necessary to carry out the purpose of this Resolution.
