RESOLUTION AUTHORIZING A MAINTENANCE AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND THE BOROUGH OF POMPTON LAKES FOR THE COUNTY TO INSTALL AND THE BOROUGH TO MAINTAIN ONE (1) RECTANGULAR RAPID FLASHING BEACON NEAR 219 WANAQUE AVENUE IN THE BOROUGH OF POMPTON LAKES, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, the Passaic County Engineering Department is responsible for protecting and enhancing the quality of life of County residents through various infrastructure projects, including bridges, culverts, drainage systems, and road/traffic operations; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County Engineer is recommending that the County enter into a maintenance agreement with the Borough of Pompton Lakes for the County to install one (1) rectangular rapid flashing beacon near 219 Wanaque Avenue approximately 190’ south of the intersection of Wanaque Avenue and Colfax Avenue in the Borough of Pompton Lakes, New Jersey (hereafter the “Project”); and
WHEREAS, on its completion, the Borough of Pompton Lakes will accept ownership and all maintenance responsibilities of the Project in compliance with the terms of the maintenance agreement, attached hereto; and
WHEREAS, this matter was discussed at the March 26, 2025, Public Works Committee meeting and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:65-1, et seq., the Board of County Commissioners of the County of Passaic hereby authorizes the maintenance agreement between the County and Borough of Pompton Lakes for the County to install one (1) rectangular rapid flashing beacon near 219 Wanaque Avenue and on its completion, the Borough will accept ownership and all maintenance responsibilities of the Project in accordance with the terms of the maintenance agreement.
LET IT BE FURTHER RESOLVED, a copy of the maintenance agreement shall be filed, for informational purposes, with the Division of Local Government Services.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board are authorized to take any other action necessary to carry out the purposes of this Resolution.
