RESOLUTION AUTHORIZING ACCEPTANCE, FINAL PAYMENT, AND PROJECT CLOSE OUT TO JOHN O’HARA COMPANY FOR THE LAMBERT CASTLE RESTORATION & REHABILITATION PROJECT, PER BID C-20-026, PURSUANT TO N.J.S.A. 40A:11-16.3 (b) ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-16.3 (b), et seq. the Board can authorize release and final payment upon acceptance of the work performed pursuant to the contract provided that the contract has been completed; and
WHEREAS, on December 8, 2020, the Board approved Resolution No. 2020-1118 awarding a contract to John O’ Hara Company, for the Lambert Castle Restoration & Rehabilitation Project in the amount of six million seven hundred ninety-two thousand four hundred fifteen dollars ($6,792,415.00); and
WHEREAS, the Director of the Department of Cultural & Historic Affairs is advising that the Lambert Castle Restoration & Rehabilitation Project has been completed and conforms to the construction plans, and standard specifications, and is requesting that the Board approve the project close out, final acceptance, release of retainage, and final payment to John O’ Hara Company; and
WHEREAS, this matter was discussed at the January 10, 2024, meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-16.3(b) et seq., by the Passaic County Board of County Commissioners hereby authorizes and approves the Project close out, final acceptance, the release of retainage, and final payment to John O’ Hara Company for the Lambert Castle Restoration & Rehabilitation Project.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of Board of County Commissioners are authorized to execute any documents and take any other action necessary to carry out the purpose of this Resolution.
