RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO LIQUIDITY SERVICES OPERATIONS LLC DBA GOVDEALS FOR ONLINE AUCTION SERVICES, PER RFP-26-002, PURSUANT TO N.J.S.A. 40A:11-4.1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the County is in need of online auction services; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1 et seq. specifically authorizes the County to utilize competitive contracting for purchase or licensing of proprietary computer software designed for contracting unit purposes; and
WHEREAS, on January 26, 2021, the Board approved Resolution No. R20210034 authorizing the use of competitive contracting to retain online auction services; and
WHEREAS, on December 11, 2025, the Purchasing Agent issued RFP-26-002 for Online Auction Services; and
WHEREAS, on December 11, 2025, proposals for RFP-26-002 were unsealed by the Purchasing Agent, with two (2) responses received, from Liquidity Services Operations LLC dba GovDeals and Municibid.com LLC; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.5(d), the proposals submitted were reviewed and ranked by an evaluation committee based on a methodology for the awarding of competitive contracts, which included technical, management, and cost related criteria; and
WHEREAS, a review committee convened and scored the proposals, and is recommending an award of contract to Liquidity Services Operations LLC dba GovDeals, for a term of one (1) year beginning April 1, 2026 and expiring March 31, 2027, with four (4) one (1) year renewal options, as set forth in the memorandum attached to and made part of this Resolution, to provide online auction services under RFP-26-002; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for proposals is a fair and open process, specifically, RFP-26-002 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, funds are available in any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s); and
WHEREAS, this matter was discussed at the March 11, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1 et seq., the Board of County Commissioners of the County of Passaic authorizes an award of contract to Liquidity Services Operations LLC dba GovDeals, for a term of one (1) year beginning April 1, 2026 and expiring March 31, 2027, with four (4) one (1) year renewal options, to provide online auction services under RFP-26-002.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to Liquidity Services Operations LLC dba GovDeals and maintain a copy of the resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution.
