RESOLUTION AUTHORIZING THE INCREASE OF HIGHWAY OPENING AND USE PERMIT FEES, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Board is authorized to establish and amend fee schedules for permits and applications administered by the County; and
WHEREAS, on February 23, 2016, the Board adopted Resolution No. R20160142 the Passaic County Highway Opening and Use Resolution, establishing the Schedule of Fees for permits, roadway openings, lane closures, bridge attachments, storage, drainage connections, and related County Roadway use activities; and
WHEREAS, the current fee schedule has remained largely unchanged for approximately ten (10) years, during which the County has experienced substantial increases in administrative costs and staff review time; and
WHEREAS, through a multi-department effort, the fee structure was reviewed to reflect present-day costs and compared to regional fee structures, and, based on that review and analysis, the Roads Department Director, the County Engineer, and the Assistant County Administrator recommend that the Board amend the fee structure as set forth in the memorandum dated July 1, 2026, attached hereto and made a part hereof; and
WHEREAS, the amended fee schedule shall be incorporated into Section X of the Highway Opening and Use Resolution and applied to all applications submitted on or after the effective date established by the Board; and
WHEREAS, this matter was discussed at the July 1, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, that the Passaic County Board of County Commissioners hereby authorizes the increase and amendment of the Highway Opening and Use Permit Fee Schedule, as set forth in the memorandum dated July 1, 2026, attached hereto and made a part hereof, effective August 1, 2026; and
LET IT BE FURTHER RESOLVED, that the amended fee schedule shall be incorporated into Section X of the Highway Opening and Use Resolution and applied to all applications submitted on or after the effective date established by the Board; and
LET IT BE FURTHER RESOLVED, that the County Administrator, County Counsel, and the Clerk of the Board are authorized to take all actions necessary to implement the revised fee schedule and to carry out the purpose of this Resolution.
