RESOLUTION AUTHORIZING AN AMENDMENT TO THE PASSAIC COUNTY SHERIFF’S OFFICES AWARD OF A CONTRACT TO TRACK GROUP FOR GPS MONITORING FOR THE PASSAIC COUNTY HUMAN SERVICES DEPARTMENT AND THE PASSAIC COUNTY JAIL (RFP-24-002), PURSUANT TO N.J.S.A. 40A:11-4.1, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) are vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff's Office (hereafter “PCSO” has requested the purchase of individual GPS monitoring units for its use, as well as for the Human Services Department for the time period from January 1, 2024 through December 31, 2025, with three (3) one-year options; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(m) specially authorizes the County to utilize competitive contracting to hire a vender to perform consulting services; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R-12-557 on July 17, 2012, authorizing competitive contracting for Continuous Electronic Monitoring Services; and
WHEREAS, thereafter the Purchasing Agent issued RFP-24-002-GPS Electronic Monitoring for the Passaic County Human Services Department and the Passaic County Jail (hereafter “RFP-24-002”), responses which were opened on November 1, 2023; and
WHEREAS, pursuant to Resolution R-23-1189, dated December 12, 2023 the Passaic County Sheriff's Office has authorized a contract award to Track Group for Electronic GPS Monitoring for two (2) years from January 1, 2024 through December 31, 2025, with an appropriation of twenty five thousand and 00/100 ($25,000.00) dollars per year for a total of fifty thousand and 00/100 ($50,000.00) dollars, with three (3) to renew; and
WHEREAS, the Board is desirous of increasing award amount for RFP-24-002 for Secure Alert D/B/A Track Group to provide GPS Electronic Monitoring Bracelets and Services for the Passaic County Human Services Department for the term January 1, 2024 to December 31, 2025; and
WHEREAS, the amount of the expenditure is fifty thousand one hundred eighty-one and 00/100 ($51,181.00) dollars; and
WHEREAS, pursuant to N.J.A.C. 5:30-11.10, the County is permitted to increase the award amount under contracts competitively bid pursuant to N.J.S.A. 40A:11-4.1, where such Contracts are deemed open-end contracts, as is the case here; and
WHEREAS, funds are available in Account No. G-01-41-810-024-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached hereto and made a part of this Resolution; and
WHEREAS, this matter was discussed at the February 6, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, that pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic authorizes an increase in the appropriation to Secure Alert D/B/A Track Group in the amount of fifty thousand one hundred eighty one and 00/100 ($50,181) dollars to provide GPS Electronic Monitoring Bracelets and Services for the Passaic County Human Services Department for the term January 1, 2024 to December 31, 2025; and
LET IT FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution.
