RESOLUTION AUTHORIZING A LICENSE AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND J FLETCHER CREAMER & SON, INC. FOR THE USE OF VACANT COUNTY LAND IN THE BOROUGH OF HALEDON, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (“Board”) is responsible for managing the property, finances, and affairs of the County; and
WHEREAS, the County is the owner of certain vacant and unused property along Valley View Road in the Borough of Haledon, located at Block 29, Lot 1 on the Tax Map of the Borough of Haledon (“Property”), which is not currently needed for any public purpose; and
WHEREAS, J. Fletcher Creamer & Son, Inc., which operates a construction project near the Property on behalf of Public Service Energy & Gas, Co., wishes to utilize approximately 9,000 square feet of vacant land at the Property (“Licensed Premises”), as shown on Schedule A of the License Agreement attached hereto and made part of this Resolution, for the purpose of storing construction vehicles, equipment, and/or supplies; and
WHEREAS, the Passaic County Administrator is recommending that the County enter into the attached license agreement with J. Fletcher Creamer & Son, Inc., to allowing them to use the Licensed Premises for the temporary storage of construction vehicles, equipment, and/or supplies on a month-to-month basis, for a license fee of five thousand dollars ($5,000.00) per month; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., J. Fletcher Creamer & Son, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed J. Fletcher Creamer & Son, Inc. is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the August 26, 2026, meeting of the Administration and Finance Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic authorizes the execution of the attached license agreement with J. Fletcher Creamer & Son, Inc., which will allow them to use certain vacant and unused property owned by the County along Valley View Road in the Borough of Haledon for the temporary storage of construction vehicles, equipment, and/or supplies on a month-to-month basis, for a license fee of five thousand dollars ($5,000.00) per month.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this Resolution.
