RESOLUTION AUTHORIZING CHANGE ORDER NO. 18 TO KONKUS CORPORATION FOR THE TWO BRIDGES ROAD BRIDGE AND WEST BELT EXTENSION PROJECT IN THE TOWNSHIP OF WAYNE AND BOROUGH OF LINCOLN PARK, PER BID C-19-007, PURSUANT TO N.J.A.C. 5:30-11.3 ET SEQ.

 WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and  

 

WHEREAS, on November 18, 2019, the Board approved Resolution No. 20191058 awarding a contract to Konkus Corporation as the lowest responsible bidder for the Two Bridges Road Bridge and West Belt Extension Project (hereafter “Project”) for a contract price of fourteen million six hundred thirty-three thousand eight hundred seventy-six dollars and eighty-nine cents ($14,633,876.89), in compliance with N.J.S.A. 40A:11-1, et seq.; and

 

WHEREAS, on December 30, 2019, the Board approved Resolution No. R20191248, amending Resolution No. R20191058 to correct the contract price for Konkus to complete the Project to fourteen million six hundred thirty-three thousand nine hundred and three dollars ($14,633,903.00); and

 

WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and

 

WHEREAS, in compliance with N.J.A.C. 5:30-11.3, et seq., the Board has approved the following change orders for the Project to date:

WHEREAS, the County Engineer is recommending approval of Change Order No. 18 in the increased amount of thirteen thousand two hundred eighty-one dollars and fifty cents ($13,281.50) due to the additions and deletions of as-built quantities needed to complete the Project, with a new total award amount, as a result of the increase, in the amount of sixteen million, three hundred twelve thousand seven hundred sixty dollars and thirty-one cents ($16,312,760.31); and

 

WHEREAS, the majority of this project will be funded by the New Jersey Department of Transportation (hereafter “NJDOT”) Grants; and

 

WHEREAS, funds are available in Account No. G-04-45-715-019-903 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution.

                     

                     WHEREAS, this matter was discussed on June 9, 2025 by the Public Works Committee and is being recommended to the Board for approval; and

 

                     NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3 et seq. the Board of County Commissioners of the County of Passaic authorizes Change Order No. 18  to Konkus Corporation for the Two Bridges Road Bridge and West Belt Extension Project in the increased amount of thirteen thousand two hundred eighty-one dollars and fifty cents ($13,281.50), with a new total contract award amount, as a result of the increase, in the amount of sixteen million, three hundred twelve thousand seven hundred sixty dollars and thirty-one cents ($16,312,760.31); and

 

LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with the general requirements for change orders as set forth in N.J.A.C. 5:30-11.3, et seq.

 

LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of the Board of County Commissioners are authorized to execute an agreement and Form SA-1 for New Jersey Department of Transportation Change Orders, and any other supporting documents required for NJDOT reimbursement and take any other action necessary to carry out the purpose of this Resolution.
