RESOLUTION APPROVING THE BID RECEIVED FROM ATLANTIC TACTICAL, INC. FOR THE PASSAIC COUNTY SHERIFF’S OFFICE BID # SB-24-042 PURSUANT TO N.J.S.A 40A: 11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff’s Office (hereafter “PCSO”) has requested the purchase of four hundred twenty-five (425) Holosun Enclosed Pistol Sight EPS Red 6 and Optic Plates for Smith & Wesson M&P9’s for the department issued firearms; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, the Passaic County Purchasing Agent issued SB-24-042 Holosun Enclosed Pistol Sight EPS Red 6 and Optic Plate for Smith and Wesson M&P9 M2.0 or Equal for the Passaic County Sheriff’s Office (hereinafter “SB-24-042”), in compliance with N.J.S.A. 40A:11-4, et seq.; and
WHEREAS, the two (2) responses for SB-24-042 were reviewed by representatives of the PCSO who are recommending the lowest bidder, Atlantic Tactical, Inc., be awarded the contract, for an amount not to exceed one hundred twenty-six thousand two hundred and eight dollars ($126,208.00); and
WHEREAS, pursuant to N.J.S.A. 40A:11-23 the County issued bid # SB-24-012 advertisement for bids which was published in advance of the date fixed for receiving the bids to promote competitive bidding; the County received bids for SB-24-012 on November 29, 2023; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed they are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available account T-22-56-850-012-803 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was reviewed by the Law and Public Safety Committee and is being recommended to the full Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED pursuant to N.J.S.A. 40A:11-4, et seq., the Board of County Commissioners of the County of Passaic is authorizing a contract award to Atlantic Tactical, Inc., for the purchase of four hundred twenty-five (425) Holosun Enclosed Pistol Sight EPS Red 6 and Optic Plates for Smith & Wesson M&P9’s for the department issued firearms, in an amount not to exceed one hundred twenty-six thousand two hundred and eight dollars ($126,208.00).
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
