RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO ROAD SAFETY SYSTEMS, LLC TO REPLACE AND REPAIR GUIDE RAILS ON PASSAIC COUNTY ROADS, RIGHT-OF-WAYS, AND BRIDGES FOR THE 2026 GUIDE RAIL REMOVAL AND REPLACEMENT PROGRAM PURSUANT TO N.J.S.A. 40A:11-10

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq.; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, the County is a member of the Morris County Cooperative Pricing Council MCCPC (“MCCPC”), a joint cooperative pricing system, offering competitive pricing for various goods and services established pursuant to N.J.S.A. 40A:11-10, et seq.; and
WHEREAS, in compliance with the law, MCCPC issued and awarded a contract to Road Safety Systems, LLC, for Beam Guide Rail & Safety Ends, under contract MCCPC#26 (“MCCPC#26”) for a contract period beginning on January 1, 2026, and expiring on December 31, 2026; and
WHEREAS, the Supervisor of Roads is recommending that the Board authorize an award of contract to Road Safety Systems, LLC, to replace and repair guide rails on Passaic County Roads, Right-of-Ways, and Bridges for the 2025 Guide Rail Removal and Replacement Program in the amount of three hundred thousand dollars ($300,000.00); and
WHEREAS, funds are available in Account No. C-04-55-194-005-901, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the April 29, 2026, Public Works Committee meeting and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to Road Safety Systems, LLC, to remove and replace guide rails on Passaic County Roads, Right-of-Ways and Bridges for the 2026 Guide Rail Removal and Replacement Program in the amount of three hundred thousand dollars ($300,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
