RESOLUTION AWARDING A NON-FAIR AND OPEN CONTRACT TO WITMER PUBLIC SAFETY GROUP TO PURCHASE POLICE EQUIPMENT FOR THE PASSAIC COUNTY PROSECUTOR’S OFFICE NARCOTICS TASK FORCE, PURSUANT TO N.J.S.A. 40A:11-3.

WHEREAS, the County of Passaic (the “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (the “Board”) is vested with managing the property, finances, and affairs of the County; and  

 

WHEREAS, the Passaic County Prosecutor’s Office (“PCPO”) is requesting police equipment expert witness services covering beginning on January 1, 2025, and expiring on December 31, 2025; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-3 when the cost or price of any contract awarded by the contracting agent in the aggregate does not exceed in a contract year the bid threshold, the contract may be awarded by a purchasing agent or other employee so designated by the governing body when so authorized by ordinance or resolution as appropriate to the contracting unit without public advertisement for bids; and

 

WHEREAS, on June 30, 2020, the Board approved Resolution No. R20200514 setting the bid threshold at forty-four thousand dollars ($44,000.00), in accordance with the law; and

 

WHEREAS, the PCPO has made efforts to obtain three quotes from multiple agencies to purchase police equipment for the Passaic County Prosecutor’s Office Narcotics Task Force in an amount not to exceed eight thousand, six hundred thirty-nine dollars, twenty-two cents ($8,639.22); and

 

WHEREAS, Witmer Public Safety Group has executed and notarized the County’s Business Entity Disclosure Certification for non-fair and open contracts required pursuant to N.J.S.A. 19:44A-20.8, which is attached to and made part of this Resolution; and

 

WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed they are not identified on the Specially Designated Nationals and Blockesherifd Persons list created by the Office of Foreign Assets Control; and

 

WHEREAS, funds are available in Account No. T-23-56-850-000-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and

 

                     WHEREAS, this matter was discussed by the Law and Public Safety Committee on March 4, 2025, and is being recommended to the Board for approval; and

 

                     NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-3 that the Board of County Commissioners of the County of Passaic authorizes a contract to Witmer Public Safety Group, in an amount not to exceed eight thousand, six hundred thirty-nine dollars, twenty-two cents ($8,639.22) to purchase police equipment for the Passaic County Prosecutor’s Office, Office Narcotics Task Force.

 

                     LET IT BE FURTHER RESOLVED, that the Clerk of the Board, Passaic County Prosecutor’s Office, County Counsel, and Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
