RESOLUTION QUALIFYING NEW JERSEY BOARD OF PUBLIC UTILITIES LICENSED THIRD-PARTY ELECTRIC AND/OR NATURAL GAS SUPPLIERS TO PROVIDE ELECTRICITY AND NATURAL GAS SUPPLY SERVICES TO PARTICIPATING MEMBERS OF THE PASSAIC COUNTY ENERGY REGIONAL COOPERATIVE PRICING SYSTEM (PCERPS) ID #203PCERCPS FOR CALENDAR YEAR 2026, PURSUANT TO N.J.S.A. 40A:11-5, ET SEQ. AND RFQ-26-050

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 48:3-93.1, et seq. and N.J.A.C. 14:4-6.1, et seq., the County is authorized to establish a government aggregator and energy aggregation program to provide for the purchase of electric generation service and natural gas; and
WHEREAS, on September 24, 2013, the Board approved Resolution No. R2013731, establishing a government energy aggregation program pursuant to N.J.S.A. 48:3-93.1, et seq. and N.J.A.C. 14:4-6.1, et seq. (“Energy Aggregation Program”); and
WHEREAS, the purpose of the Energy Aggregation Program is to increase the competition of electric generation and natural gas services, thereby lowering electric and natural gas rates for County residents and non-resident users; and
WHEREAS, as part of the Energy Aggregation Program, the County requires qualified New Jersey Board Utilities licensed third-party electric and/or natural gas suppliers to provide electric and natural gas services to participating members of the Passaic County Energy Regional Cooperative Pricing System (“PCERCPS”) ID #203PCERCPS; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, on October 31, 2025, the Passaic County Purchasing Agent issued RFQ-26-050, New Jersey Board of Public Utilities (NJBPU) Licensed Third Party Electric and/or Natural Gas Suppliers (“RFQ-26-050”), seeking qualifications for a pool of licensed third-party electric and/or natural gas suppliers for 2026; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.7, the County’s request for qualifications is a fair and open process, specifically, the request for qualifications for licensed third-party electric and/or natural gas suppliers for calendar year 2026 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, in response to RFQ-26-050, the County received qualifications on November 13, 2025 from Constellation NewEnergy, Inc.; Direct Energy Business, LLC; Great American Gas and Electric, LLC; NRG Business Marketing LLC; Sprague Operating Resources, LLC; and WGL Energy Services, Inc.; and
WHEREAS, after review of the qualifications submitted, the Purchasing Agent is recommending to qualify the following NJBPU licensed third-party electric and/or natural gas suppliers to provide electricity and natural gas supply services to participating members of PCERCPS ID #203PCERCPS for calendar year 2026: Constellation NewEnergy, Inc.; Direct Energy Business, LLC; Great American Gas and Electric, LLC; NRG Business Marketing LLC; Sprague Operating Resources, LLC; and WGL Energy Services, Inc.; and
WHEREAS, this matter was discussed at the November 26, 2025 Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5(1)(a)(i), the Board of County Commissioners of the County of Passaic qualifies the following New Jersey Board of Public Utilities licensed third-party electric and/or natural gas suppliers to provide electricity and natural gas supply services to participating members of the Passaic County Energy Regional Cooperative Pricing System ID #203PCERCPS for calendar year 2026, in accordance with the vendors’ responses to RFQ-26-050:
1. Constellation NewEnergy, Inc.
2. Direct Energy Business, LLC
3. Great American Gas and Electric, LLC
4. NRG Business Marketing LLC
5. Sprague Operating Resources, LLC
6. WGL Energy Services, Inc.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator, Purchasing Agent and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
