RESOLUTION AWARDING A CONTRACT TO REMOVE AND REPLACE THE ROOF ON THE COUNTY BUILDING LOCATED AT 61 COLUMBIA AVENUE, PATERSON, NEW JERSEY, PURSUANT TO N.J.S.A. 40A:11-3.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff’s Office (hereinafter PCSO) is requesting to remove and replace the roof on the County building located at 61 Columbia Avenue, Paterson, New Jersey; and
WHEREAS, pursuant to N.J.S.A. 40A:11-3 when the cost or price of any contract awarded by the contracting agent in the aggregate does not exceed in a contract year the bid threshold, the contract may be awarded by a purchasing agent or other employee so designated by the governing body when so authorized by ordinance or resolution as appropriate to the contracting unit without public advertisement for bids; and
WHEREAS, on June 30, 2020 the Board approved Resolution No. R20200514 setting the bid threshold at forty-four thousand dollars ($44,000.00), in accordance with the law; and
WHEREAS, the PCSO has obtained three (3) quotes for the removal and replacement of the roof on the building located at 61 Columbia Avenue, Paterson, New Jersey and are requesting to award the contract to the vendor with the lowest quote, Universal Roofing Solutions, LLC, in an amount not to exceed twenty-nine thousand three hundred and fifty dollars ($29,350.00) which is below the bid threshold; and
WHEREAS, Universal Roofing Solutions, LLC, has executed and notarized the County’s Business Entity Disclosure Certification for non-fair and open contracts required pursuant to N.J.S.A. 19:44A-20.8, which is attached to and made part of this Resolution; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendor has executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vendor is not involved in prohibited activities in Russia and Belarus, and the County confirmed they are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. C-04-55-163-001-902 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed by the Law and Public Safety Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-3 that the Board of County Commissioners of the County of Passaic authorizes a contract with Universal Roofing Solutions, LLC, for the removal and replacement of the roof on the building located at 61 Columbia Avenue, Paterson, New Jersey in an amount not to exceed twenty-nine thousand three hundred and fifty dollars ($29,350.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and the Director of the Board are authorized to take any other steps necessary to carry out the purpose of this resolution.
