RESOLUTION AUTHORIZING AN INCREASE IN THE APPROPRIATION TO FRANK GARGIULO AND SON, INC. dba GARGIULO PRODUCE TO PAY REMAINING 2024 INVOICES, PURSUANT TO N.J.S.A. 40A:11-10, ET SEQ. AND N.J.S.A. 40A-11-12, ET SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to Resolution R-23-1200 dated December 28, 2023, the Board passed an omnibus purchasing resolution for calendar year 2024, pursuant to N.J.S.A. 40A:11-10, et seq. and N.J.S.A. 40A:11-12, et seq., which included a contract award to Frank Gargiu lo and Son, Inc. dba Gargiulo Produce; and
WHEREAS, the Executive Director of Preakness Healthcare Center is requesting a resolution increasing the appropriation to $5,597.00 to pay remaining 2024 invoices; and
WHEREAS, funds are available in Account Nos. 4-01-27-172-001-F04 and 4-01-27-172-001-M02 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., vendor executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying the vender is not involved in prohibited activities in Russia and Belarus, and the County confirmed vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the February 18, 2025, meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-10, et seq. and N.J.S.A. 40A-11-12, et seq., the Board of County Commissioners of the County of Passaic authorizes an increase in the appropriation to Frank Garguilo and Son, Inc. dba Gargiulo Produce to pay remaining 2024 invoices; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, County Counsel and Director of the Board of County of Commissioners are authorized to take any other steps necessary to carry out the purpose of this Resolution.
