RESOLUTION AUTHORIZING AWARD OF CONTRACT TO CUSTOM TRUCK ONE SOURCE, INC., DBA TNT EQUIPMENT SALES & RENTALS, LLC FOR TEREX XT PRO 56 FORESTRY OVERCENTER AERIAL DEVICE OR EQUAL, SB-26-030, PURSUANT TO N.J.S.A. 40A:11-4 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on April 21, 2026 the Purchasing Agent issued SB-26-030, 2026 or Newer Terex XT PRO 56 Forestry Overcenter Aerial Device or Equal (hereafter “SB-26-030”), in compliance with N.J.S.A. 40A:11-4, et seq., that solicited competitive pricing from qualified vendors for the purchase of a 2026 or newer Terex XT PRO 56 Forestry Overcenter Aerial Device or equal; and
WHEREAS, on May 1, 2026, one (1) bid was received under SB-26-030, such bid being submitted by Custom Truck One Source, Inc., dba TNT Equipment Sales & Rentals, LLC; and
WHEREAS, the Director of the Department of Parks & Recreation is recommending that the Board authorize an award of contract to Custom Truck One Source, Inc., to purchase a 2026 or newer Terex XT PRO 56 Forestry Overcenter Aerial Device or equal, pursuant to their response to SB-26-030 in an amount not to exceed one hundred seventy eight thousand three hundred forty-seven dollars ($178,347.00); and
WHEREAS, Custom Truck One Source, Inc., has offered their prices to members of the Passaic County Cooperative #38PCCP for the term of June 1, 2026 - May 31, 2027; and
WHEREAS, funds are available in Account No. 6-01-44-900-003-000, or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the June 10, 2026 meeting of the Public Works Committee, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, the Board of County Commissioners of the County of Passaic hereby authorizes an award of contract to Custom Truck One Source, Inc., to purchase a 2026 or newer Terex XT PRO 56 Forestry Overcenter Aerial Device or equal, pursuant to their response to SB-26-030 in an amount not to exceed one hundred seventy eight thousand three hundred forty-seven dollars ($178,347.00);.
LET IT BE FURTHER RESOLVED that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to take any other steps necessary to carry out the purpose of this resolution.
