RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO KEEGAN TECHNOLOGY & TESTING ASSOCIATES, INC., T/A KEY-TECH, TO PROVIDE CONCRETE AND ASPHALT TESTING FOR THE PATERSON HAMBURG TURNPIKE/ALPS ROAD INTERSECTION IMPROVEMENTS PROJECT PER SB-23-005, PURSUANT TO N.J.S.A 40A:11-4 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on October 21, 2022, the Purchasing Agent received bids for the On-Call Construction and Geotechnical Testing Services and to establish unit pricing for the on-call services, SB-23-005 (hereafter “SB-23-005”), in compliance with N.J.S.A. 40A:11-4, et seq.; and
WHEREAS, a total of three qualified bids were received as follows:
1. French and Parrello Associates, PA;
2. Keegan Technology & Testing Associates, Inc, T/A Key-Tech; and
3. Tectonic Engineering Consultants, Geologists & Land Surveyors, DPC Inc.
WHEREAS, on November 22, 2022, the Board passed Resolution R-22-1039 qualifying a pool of construction and geotechnical testing companies and establishing unit prices for the On-Call Construction and Geotechnical Testing Services for a two-year period beginning on January 1, 2023, expiring on December 31, 2024, as recommended by the County Engineer, to be hired on an as-needed basis, which included Keegan Technology & Testing Associates, Inc, T/A Key-Tech; and
WHEREAS, the County Engineer is recommending that the Board award a contract to Keegan Technology & Testing Associates, Inc, T/A Key-Tech to provide concrete and asphalt for the Paterson Hamburg Turnpike/Alps Road Intersection Improvements Project in the Township of Wayne pursuant to their unit pricing in an amount not to two exceed twelve thousand four hundred seventy-five dollars ($12,475.00); and
WHEREAS, funds are available in Account No. G-01-45-700-021-911 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at a meeting on March 13, 2024, by the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4, that the Board of County Commissioners of the County of Passaic authorizes the award of contract to Keegan Technology & Testing Associates, Inc, T/A Key-Tech to provide concrete and asphalt for the Paterson Hamburg Turnpike/Alps Road Intersection Improvements Project consistent with their unit pricing in an amount not to two exceed twelve thousand four hundred seventy-five dollars ($12,475.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Finance Officer, and County Engineer execute any documents required by the NJDOT for project reimbursement and take any other steps necessary to carry out the purpose of this resolution.
