RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO THE SALVATION ARMY FOR THE PROVISION OF HOT FOOD SOUP KITCHEN SERVICES UNDER THE CONGREGATE FOOD PROGRAMS GRANT ADMINISTERED BY THE PASSAIC COUNTY DEPARTMENT OF HUMAN SERVICES, PURSUANT TO RFP-26-037 AND N.J.S.A. 40A:11-4.1 ET SEQ.

WHEREAS, the County of Passaic (“County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (“Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the Department of Human Services (“Department”) is an umbrella social service agency concerned with planning and funding services for disadvantaged and homeless citizens; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b)(2) specifically authorizes the County to utilize competitive contracting to procure services related to the operation, management or administration of social service programs, under which this program falls; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution R2019-0286, dated March 26, 2019, authorizing the Department to initiate the RFP process to procure services related to the administration of social service programs; and
WHEREAS, on August 17, 2026, the Purchasing Agent issued RFP-26-037, Congregate Food Programs Grant Administered by the Passaic County Department of Human Services (“RFP-26-037”), responses to which were unsealed on September 10, 2026; and
WHEREAS, in accordance with the law, a Review Committee was convened to review the responses to RFP-26-037 and in a memorandum attached to and made part of this Resolution, recommended an award of contract to the Salvation Army to provide Hot Food Soup Kitchen Services for an amount not to exceed twenty-nine thousand eight hundred thirty dollars and sixty cents ($29,830.60) during a term from October 1, 2026 to September 30, 2027, with the County retaining four (4) one-year options to renew, contingent on availability of funds and satisfactory performance; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the Salvation Army executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that the Salvation Army is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. G-01-41-818-026-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was presented to the Health and Human Services Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, the Board of County Commissioners of the County of Passaic authorizes a contract award to the Salvation Army to provide Hot Food Soup Kitchen Services pursuant to RFP-26-037, for an amount not to exceed twenty-nine thousand eight hundred thirty dollars and sixty cents ($29,830.60) during a term from October 1, 2026 to September 30, 2027, with the County retaining four (4) one-year options to renew, contingent on availability of funds and satisfactory performance, all in accordance with the terms of RFP-26-037 and the provider’s response thereto.
LET IT BE FURTHER RESOLVED, the Clerk to the Board shall publish on the Public Notices page of the County’s website, a brief notice stating the nature, duration, service, and amount of the contract to the Salvation Army, and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, Director of the Department, and County Counsel are authorized to take any actions necessary to carry out the purpose of this Resolution.
