RESOLUTION AUTHORIZING AN INCREASE IN THE APPROPRIATION UNDER THE CONTRACT WITH AA BERMS, LLC, FOR SNOW PLOWING ON PASSAIC COUNTY ROADS FOR THE ROAD DEPARTMENT, PER SB-26-003, PURSUANT TO N.J.A.C. 5:30-11.10

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on October 1, 2025, the Purchasing Agent issued Snow Plowing for Passaic County Roads, SB-26-003 (hereafter “SB-26-003”), in compliance with N.J.S.A. 40A:11-4, et seq., seeking a contractor to provide snow plowing services for the County Road Department; and
WHEREAS, the lowest responsible bidder to SB-26-003 was AA Berms, LLC; and
WHEREAS, on November 17, 2025, the Board passed Resolution No. R-25-1109, authorizing an award of contract to AA Berms, LLC, to perform snow removal on County roads at the rates set forth in its response to SB-26-003, for the period beginning January 1, 2026 and expiring December 31, 2026; and
WHEREAS, pursuant to N.J.A.C. 5:30-11.10, the County is permitted to increase the award amount under contracts competitively bid pursuant to N.J.S.A. 40A:11-4, where such contracts are deemed open-end contracts, as is the case here; and
WHEREAS, due to an increased need in snow removal services under SB-26-003, the Supervisor of Roads is seeking authorization for an additional appropriation for the contract with AA Berms, LLC, under SB-26-003, in an amount not to exceed one million dollars ($1,000,000.00) which is being recommended for approval; and
WHEREAS, funds are available in Account No. T-20-56-880-022-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the March 11, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.10, that the Board of County Commissioners of the County of Passaic authorizes the increase in appropriation for the contract with AA Berms, LLC, under SB-26-003 in an amount not to exceed one million dollars ($1,000,000.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
