RESOLUTION AUTHORIZING CHANGE ORDER NO. 1 FOR COLONNELLI BROTHERS, INC., FOR ON CALL BRIDGE REPAIRS TO CHURCH STREET BRIDGE NO. 1600-125 OVER MOLLY ANN’S BROOK IN THE BOROUGH OF HALEDON, PER BID C-22-003, PURSUANT TO N.J.A.C. 5:30-11.3 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, on January 31, 2022, the Purchasing Agent issued Bid No. C-22-003, On-Call Bridge and Culvert Repair Contract (hereafter “C-23-003”) seeking sealed proposals from qualified bidders for on-call bridge and culvert repairs on an as-needed basis beginning February 16, 2022, and expiring on December 31, 2023; and
WHEREAS, on February 15, 2022, the Board approved Resolution R-22-0149 qualifying contractors and unit prices to perform on-call bridge and culvert repairs on an as-needed basis for the period beginning on February 16, 2022, and expiring on December 31, 2023, which included Colonnelli Brothers, Inc.; and
WHEREAS, on August 8, 2023, the Board passed Resolution No. R-23-0745 authorizing an award of contract to Colonnelli Brothers, Inc. for on-call bridge repairs at the Church Street Bridge No. 1600-125 over Molly Ann Brook in the Borough of Haledon in an amount not to exceed seventy-one, nine hundred dollars ($71,900.00)
WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and
WHEREAS, the Passaic County Engineer is recommending that Change Order No. 1 be authorized for a net deduction to the contract for the Project in the amount of twelve thousand two hundred sixty-seven dollars and twenty-five cents ($12,267.25) due to the addition and subtraction of as-built quantities needed to complete the Project, with a new contract award, as a result of the decrease, of fifty-nine thousand six hundred thirty-two dollars and seventy-five cents ($59,632.75); and
WHEREAS, the project is anticipated to be partially reimbursed by FEMA due to damages caused by Hurricane Ida; and
WHEREAS, this matter was discussed at the March 27, 2024, meeting of the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3, et seq., the Board of County Commissioners of the County of Passaic approves Change Order No. 1 for the contract with Colonnelli Brothers, Inc., for on-call bridge repairs at the Church Street Bridge No. 1600-125 over Molly Ann Brook in the Borough of Haledon for a net deduction in the amount of twelve thousand two hundred sixty-seven dollars and twenty-five cents ($12,267.25) with an updated contract amount, as a result of the decrease, in the amount of fifty-nine thousand six hundred thirty-two dollars and seventy-five cents ($59,632.75).
LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with all of the general requirements for change orders as set forth in N.J.A.C. 5:30-11.3, et seq.
