RESOLUTION AUTHORIZING CHANGE ORDER NO. 5 FOR CAP ELEVATOR, LLC, FOR THE MODERNIZATION OF THE PRISONER ELEVATOR AT 401 GRAND STREET IN THE CITY OF PATERSON AND THE INSTALLATION OF AN ACCESSIBILITY LIFT ELEVATOR AT THE SHERIFF’S HEADQUARTERS IN THE TOWNSHIP OF WAYNE, PER BID C-24-009, PURSUANT TO N.J.A.C. 5:30-11.3 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and 

 

WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., every contract awarded by the County, for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold [40A:11-3], shall be awarded only by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and

 

WHEREAS, on May 16, 2024, the Purchasing Agent issued 401 Grand St Prisoner Elevator Modernization (Paterson, NJ) and Sheriff’s Headquarters 435 Hamburg Turnpike Accessibility Lift Elevator Installation (Wayne, NJ), C-24-009 (hereafter “C-24-009”) seeking sealed proposals from qualified bidders to renovate and modernize the prisoner elevator at the 401 Grand Street in the City of Paterson and to construct an accessibility lift elevator at the Sheriff’s Headquarters in the Township of Wayne; and

 

WHEREAS, on June 11, 2024, the Board passed Resolution No. R-24-541 authorizing an award of contract to CAP Elevator, LLC, the lowest responsible bidder under C-24-009, in an amount not to exceed five hundred ninety thousand dollars ($590,000.00); and

 

WHEREAS, pursuant to N.J.A.C. 5:30-11.3, et seq. the Board can authorize, permit, or accept change orders for work performed, services rendered, materials, supplies, or equipment delivered or provided pursuant to the conditions as set forth therein; and

 

WHEREAS, on July 15, 2025, the Board passed Resolution No. R-25-0656, authorizing Change Order No. 1 for the project under C-24-009, in the increased amount of forty-three thousand one hundred twenty dollars ($43,120.00) with a new total contract award, as a result of the increase, in the amount of six hundred thirty-three thousand one hundred twenty dollars ($633,120.00); and

 

WHEREAS, on September 9, 2025, the Board passed Resolution No. R-25-0838, authorizing Change Order No. 2 for the project under C-24-009, in the increased amount of four thousand two hundred seventy dollars ($4,270.00), with a new total contract award, as a result of the increase, in the amount of six hundred thirty-seven thousand three hundred ninety dollars ($637,390.00); and

 

WHEREAS, on September 30, 2025, the Board passed Resolution No. R-25-901, authorizing Change Order No. 3 for the project under C-24-009, in the increased amount of nine thousand four hundred dollars ($9,400.00), with a new total contract award, as a result of the increase, in the amount of six hundred forty-six thousand seven hundred ninety dollars ($646,790.00); and

 

WHEREAS, on October 14, 2025, the Board passed Resolution No. R-25-962, authorizing Change Order No. 4 for the project under C-24-009, in the increased amount of twenty-five thousand seven hundred dollars ($25,700.00), with a new total contract award, as a result of the increase, in the amount of six hundred seventy two thousand four hundred ninety dollars ($672,490.00); and

 

WHEREAS, the Passaic County Engineer is recommending that Change Order No. 5 be authorized for a net deduction in an amount of one hundred seventy-two dollars ($172.00) to address a credit for a heat detector no longer required in an elevator, with a new total contract award as a result of the deduction, in an amount of six hundred seventy two three hundred eighteen dollars ($672,318.00); and

 

                     WHEREAS, this matter was discussed at the January 28, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.A.C. 5:30-11.3, et seq., the Board of County Commissioners of the County of Passaic authorize Change Order No. 5 for the contract with CAP Elevator, LLC, under C-24-009, in the decreased amount of one hundred seventy two dollars ($172.00), with a new total contract award as a result of the deduction, in an amount of six hundred seventy two three hundred eighteen dollars ($672,318.00).

 

                      LET IT BE FURTHER RESOLVED, that the County Engineer is authorized and directed to comply with all of the general requirements for change orders as set forth in N.J.A.C. 5:30-11.3, et seq.

 

LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, County Engineer, and Director of Board of County Commissioners are authorized to take any other action necessary to carry out the purpose of this Resolution.
