RESOLUTION AUTHORIZING A RIGHT OF ENTRY AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND STATE OF NEW JERSEY, DEPARTMENT OF ENVIRONMENTAL PROTECTION, FOR THE GREENWOOD LAKE TURNPIKE BRIDGE NO. 1600-513 DECK REPLACEMENT & VARIOUS BRIDGE REPAIRS PROJECT IN THE TOWNSHIP OF WEST MILFORD, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq.; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, on November 18, 2024, the Board passed Resolution No. R-24-1043, authorizing an award of contract to Colonnelli Brothers, Inc., for the Greenwood Lake Turnpike Bridge No. 1600-513 Deck Replacement & Various Bridge Repairs bid under C-24-021 (hereafter “Project”); and
WHEREAS, as part of the Project, Colonnelli Brothers, Inc., must traverse through Long Pond Ironworks State Park in order to access bridge components to make necessary repairs; and
WHEREAS, the Passaic County Engineer is recommending that the Board authorize execution of a Right of Entry Agreement between the County and the State of New Jersey, Department of Environmental Protection, whereby Colonnelli Brothers, Inc., would be permitted to enter state park land for the purposes of accessing bridge components pursuant to certain conditions, such agreement attached hereto and made part hereof; and
WHEREAS, this matter was discussed at the April 9, 2025 meeting of the Public Works Committee meeting and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, et seq., the Board of County Commissioners of the County of Passaic hereby authorizes the execution of a Right of Entry Agreement between the County of Passaic and State of New Jersey, Department of Environmental Protection, for the Greenwood Lake Turnpike Bridge No. 1600-513 Deck Replacement & Various Bridge Repairs Project.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board are authorized to take any other action necessary to carry out the purposes of this Resolution.
