RESOLUTION AUTHORIZING A MAINTENANCE AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND THE BOROUGH OF WANAQUE FOR THE REPLACEMENT OF PEDESTRIAN BRIDGES ALONG CONKLINTOWN ROAD IN THE BOROUGH OF WNAQUE, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Passaic Board of County Commissioners (the “Board”) is vested with the powers to make all decisions on behalf of the County; and
WHEREAS, the Passaic County Engineering Department is responsible for protecting and enhancing the quality of life of County residents through various infrastructure projects, including bridges, culverts, drainage systems, and road/traffic operations; and
WHEREAS, the County is responsible for the maintenance of two culverts (Structures #1600-187 and #1660-188) underneath Conklintown Road in the Borough of Wanaque; and
WHEREAS, the Borough of Wanaque is responsible for the maintenance of two pedestrian bridges adjacent to the two Conklintown culverts; and
WHEREAS, the County Engineer is recommending that the County enter into a maintenance agreement with the Borough of Wanaque whereby the County will replace the superstructures of the two above-referenced pedestrian bridges at no cost to the Borough of Wanaque; and
WHEREAS, on its completion, the Borough of Wanaque will accept ownership and all maintenance responsibilities of the two pedestrian bridges in compliance with the terms of the maintenance agreement, attached hereto; and
WHEREAS, this matter was discussed at the May 13, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, et seq., the Board of County Commissioners of the County of Passaic hereby authorizes the maintenance agreement between the County and Borough of Wanaque for the County to replace the superstructures of two pedestrian bridges along Conklintown Road in the Borough of Wanaque, the Borough will accept ownership and all maintenance responsibilities of the said pedestrian bridges in accordance with the terms of the maintenance agreement.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Engineer, County Counsel, and Director of the Board are authorized to take any other action necessary to carry out the purposes of this Resolution.
