RESOLUTION AUTHORIZING INCREASE TO AMOUNT OF CONTRACT WITH CUMAC ECHO, INC. TO PROVIDE MOBILE FOOD PANTRY SERVICES UNDER RFP-24-017 FOR THE 2025 CALENDAR YEAR, PURSUANT TO N.J.S.A. 40A:11-4.1, ET.SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the Department of Human Services (hereafter “Department”) is an umbrella social service agency concerned with planning and funding services for disadvantaged and homeless citizens; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, N.J.S.A. 40A:11-4.1(b) specifically authorizes the County to utilize competitive contracting to procure services related to the administration of social services programs, under which this program falls; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution No. R23-0616, dated June 27, 2023, authorizing the Department to initiate the RFP process for the provision of services, care management and transportation services for individuals and families who are homeless and at risk of homelessness; and
WHEREAS, on April 24, 2024, the County Purchasing Agent issued RFP-24-017, Mobile Food Pantry and Referral Services Administered by the County Department of Human Services (“RFP-24-017”), responses to which were received on May 14, 2024; and
WHEREAS, in accordance with the law, a review committee convened to review the responses to RFP-24-017, and recommended the award of a contract to CUMAC ECHO, Inc. to provide mobile food pantry services; and
WHEREAS, on June 11, 2024, the Board approved Resolution No. R-24-508, authorizing the award of a contract to CUMAC ECHO, Inc. for the provision of mobile food pantry services from June 1, 2024, to December 31, 2024, with up to four (4) one (1) year options to renew; and
WHEREAS, on December 30, 2024, the Board approved Resolution No. R-24-1206, exercising the first one-year option under the above-described contract for the 2025 calendar year, for a total amount of seventy-seven thousand eight hundred seventy-five and 00/100 dollars ($77,875.00); and
WHEREAS, the Director of the Department is recommending that the amount of the above-described contract be increased by thirty-one thousand five hundred and 00/100 dollars ($31,500.00) to a new total of one hundred nine thousand three hundred seventy-five and 00/100 dollars ($109,375.00), in order for CUMAC ECHO, Inc. to provide Food Assistance Navigation as part of the services offered by the Mobile Food Pantry; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., CUMAC ECHO, Inc. executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that they are not involved in prohibited activities in Russia and Belarus, and the County confirmed that said vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. 5-01-27-160-001-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the February 4, 2025 meeting of the Health and Human Services Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby increases the amount of the contract with CUMAC ECHO, Inc. under RFP-24-017, Mobile Food Pantry and Referral Services Administered by the County Department of Human Services, for calendar year 2025, from January 1, 2025 to December 31, 2025, by thirty-one thousand five hundred and 00/100 dollars ($31,500.00) to a new total of one hundred nine thousand three hundred seventy-five and 00/100 dollars ($109,375.00), in order for CUMAC ECHO, Inc. to provide Food Assistance Navigation as part of the services offered by the Mobile Food Pantry.
LET IT BE FURTHER RESOLVED, the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract to CUMAC ECHO, Inc. as stated herein and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, County Counsel, and Director of the Department of Human Services are authorized to take any other steps necessary to carry out the purpose of this Resolution.
