RESOLUTION TO EXTEND A CONTRACT WITH CAR CARE SOLUTIONS, D/B/A PERFECT SHINE AUTO SALON TO PROVIDE CAR WASHING SERVICES FOR PASSAIC COUNTY VEHICLES, PURSUANT TO N.J.S.A. 40A:11-15 AND N.J.A.C. 5:30-11.10

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Passaic Board of County Commissioners (hereafter “Board”) is vested with decision-making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, the Purchasing Agent issued SB-23-046, Car Wash Service for Passaic County Vehicles (hereafter “SB-23-046”) that solicited competitive pricing for car washing services for the County’s vehicles; and
WHEREAS, the lowest responsible bidder to SB-23-046 was Car Care Solutions, Inc., d/b/a Perfect Shine Auto Salon; and
WHEREAS, on April 25, 2023, the Board passed Resolution No. R-23-0427, authorizing an award of contract to Car Care Solution Inc., d/b/a Perfect Shine Auto Salon to provide car wash services under SB-23-046 for County vehicles in an amount not to exceed sixteen thousand, six hundred eighty dollars ($16,680.00) per year with a term beginning May 1, 2023, through April 30, 2024, with one (1) year option to renew; and
WHEREAS, pursuant to N.J.S.A. 40A:11-15, the Supervisor of Roads is recommending extending the contract between Car Care Solution Inc., d/b/a Perfect Shine Auto Salon to provide car wash services under SB-23-046 for County vehicles in an amount not to exceed sixteen thousand six hundred eighty dollars ($16,680.00) per year with a term beginning May 1, 2024, through April 30, 2025, as per the one (1) year option to renew; and
WHEREAS, pursuant to N.J.A.C. 5:30-11.10, the County is permitted to increase the award amount under contracts competitively bid pursuant to N.J.S.A. 40A:11-4, where such contracts are deemed open-end contracts, as is the case here; and
WHEREAS, funds are available in Account No. 4-01-26-151-001-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget (s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at a meeting on March 13, 2024, by the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-15, that the Board of County Commissioners of the County of Passaic authorizes the contract with Car Care Solution Inc., d/b/a Perfect Shine Auto Salon, under SB-23-046, for the period beginning on May 1, 2024, and expiring on April 30, 2025.
LET IT BE FURTHER RESOLVED, pursuant to N.J.A.C. 5:30-11.10, that the Board of County Commissioners of the County of Passaic authorizes the increase in appropriation to Car Care Solution Inc., d/b/a Perfect Shine Auto Salon, under SB-23-046, in an amount not to exceed sixteen thousand six hundred eighty dollars ($16,680.00).
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contracts and take any other steps necessary to carry out the purpose of this resolution.
