RESOLUTION AUTHORIZING A PUBLIC HEARING FOR CERTAIN RECOMMENDATIONS FROM THE OPEN SPACE, FARMLAND AND HISTORIC PRESERVATION TRUST ADVISORY COMMITTEE FOR 2025, AS AUTHORIZED BY N.J.S.A. 40:12-15.3(b).

                     WHEREAS, the Board of County Commissioners of the County of Passaic (hereafter “Board”) created an Open Space, Farmland and Historic Preservation Trust Fund Program (hereafter “Program”) in conformity with the will of the voters in the 1996 election, as authorized by N.J.S.A. 40:12-15.2; and

                     WHEREAS, the purpose and goals of the above is to achieve, in partnership with others, a system of interconnected open spaces, whose protection will preserve and enhance New Jersey’s natural environment and its historic, scenic, and recreational resources for public use and enjoyment; and

                     WHEREAS, pursuant to the mandates of the Program, the said Board did approve and appoint an Open Space, Farmland and Historic Preservation Trust Fund Advisory Committee (hereafter “the Committee”) to study the open space issue and make recommendations concerning the distribution of funds to worthy applicants; and

                     WHEREAS, numerous municipalities and non-profit organizations submitted grant applications for funding under the 2025 Program rounding of funding; and

                     WHEREAS, since the recommended award for the below-proposed projects exceed one hundred thousand and 00/100 ($100,000.00) dollars each, N.J.S.A. 40:12-15.3(b) maintains that a public hearing be heard at least thirty (30) days advance notice before the date of the hearing; and

                     WHEREAS, the Committee has reviewed these grant proposals and has made recommendations for awards requiring a public hearing totaling two million five hundred forty seven thousand four hundred and 00/100 ($2,547,400.00) dollars; and

                     WHEREAS, it is the intention of the Board to make the following awards after a public hearing is scheduled pursuant to statutory requirements:

                     WHEREAS, the Board requires an express condition that all municipalities receiving these funds must agree to place in their tax letter an insert that indicates that they received funds from the Program sponsored by the Board; and

                     WHEREAS, the matter was discussed at the May 15, 2025, meeting of the Planning and Economic Development Committee, where all the recommended grant awards for 2025 were presented in accordance with the Committee’s recommendations from their May 14, 2025, meeting and are being recommended to the Board for approval; and

                     WHEREAS, after the statutory requirements of a public hearing are satisfied, certification of funds shall be made indicating that funds are available for the within contemplated expenditure; and

                     NOW,  THEREFORE, LET IT BE RESOLVED pursuant to N.J.S.A. 40:12-15.3(b), the Board of County Commissioners of the County of Passaic hereby authorizes the Clerk to the Board to publish in a newspaper of local circulation notice of a public hearing for public comments on the recommendations of awards as set forth above; and

                     LET IT BE FURTHER RESOLVED that as an express condition, all municipalities receiving funds must agree to place in their tax letter an insert that indicates that they received funds from the Passaic County Open Space, Farmland and Historic Preservation Trust Fund Program sponsored by the Board of County Commissioners of the County of Passaic; and

                     LET IT BE FURTHER RESOLVED that a public hearing shall take place on July 15, 2025 at the County of Passaic Administration Building at 5:30 P.M., pursuant to N.J.S.A. 40:12-15.3(b) regarding the following possible 2025 Passaic County Open Space, Farmland and Historic Preservation Trust Fund award expenditures:
