RESOLUTION AUTHORIZING AN INCREASE IN APPROPRIATION TO QUALIFIED VENDORS FOR RFQ-23-074 WEATHERIZATION ASSISTANCE PROGRAM RESIDENTIAL HEATING SYSTEMS UPGRADES AND REPAIRS ON AN AS-NEEDED BASIS BY THE DIVISION OF WEATHERIZATION, PURSUANT TO N.J.S.A. 40A:11-5, ET SEQ.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision-making powers on behalf of the County; and
WHEREAS, the County, through its Division of Weatherization and Home Energy (hereafter “Division”) of the Department of Senior Services administers various programs to reduce energy costs for low- income residents in Passaic County by improving energy efficiency; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5, et seq., the Purchasing Agent issued RFQ-23-074: Weatherization Assistance Program Residential Heating Systems Upgrades and Repairs (hereafter “RFQ-23-074”), in seeking qualified contractors for residential heating systems upgrades and repairs; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for qualifications is a fair and open process, specifically, the qualification for RFQ-23-074 is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and are publicly opened and announced when awarded pursuant to; and
WHEREAS, pursuant to R-23-0667, dated July 18, 2023, the Board qualified and awarded contracts to the below referenced vendors (through RFQ-23-074) to provide residential heating systems upgrades and repairs for the Division on an as-needed basis, for the period August 1, 2023, through July 31, 2024, with an appropriation of ten thousand and 00/100 ($10,000.00) dollars:
Premium Mechanical HVAC, LLC, of West Caldwell, NJ;
JW Pierson Co., of East Orange, NJ;
TM Adams, Inc., of Saddle Brook, NJ ;
Divine Energy Solutions, of Dover, NJ; and
WHEREAS, the Division subsequently received the Heating Improvement Program 2023 grant in the amount of two hundred fifty five thousand and 00/100 ($255,000.00) dollars and requested to add said funds to the appropriation amount for qualified vendors above, increasing the total appropriation amount of RFQ-23-074 to two hundred sixty five thousand and 00/100 ($265,000.00) dollars; and
WHEREAS, pursuant to R-23-0819, dated September 5, 2023, the Board authorized an increase in appropriation for the contracts to the above referenced qualified vendors under RFQ-23-074 in the amount of two hundred fifty five thousand and 00/100 ($255,000.00) dollars on an as-needed basis for the period August 1, 2023 through July 31, 2024, increasing the total appropriation amount to two hundred sixty five thousand and 00/100 ($265,000.00) dollars; and
WHEREAS, subsequently, the Division received the Heating Improvement Program (hereafter “HIP”) 2024 grant, and is requesting to add HIP 2024 funds in the amount of one hundred eighty one thousand one hundred twelve and 00/100 ($181,112.00) dollars to the appropriation amount for qualified vendors above, increasing the total appropriation amount for RFQ-22-075 to four hundred forty six thousand one hundred twelve and 00/100 ($446,112.00) dollars; and
WHEREAS, funds are available in Account No. G-01-41-707-024-213, or any account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., the vendors executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification certifying the vendors are not involved in prohibited activities in Russia and Belarus, and the County confirmed vendors are not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the April 2, 22024 meeting of the Health and Human Services Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5, et seq., the Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby authorizes an increase in the appropriation for the contracts to the above mentioned qualified vendors under RFQ-23-074 in the amount of one hundred eighty one thousand one hundred twelve ($181,112.00) dollars on an as-needed basis for the period August 1, 2023 through July 31, 2024, increasing the total appropriation amount to four hundred forty six thousand one hundred twelve ($446,112.00) dollars; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board shall print, in the official newspaper, a brief notice stating the nature, duration, service, and amount of the contract awarded to the above named vendors and maintain a copy of this Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board, Director to the Weatherization & Home Energy, and Purchasing Agent are authorized to take any action necessary to carry out the purpose of this Resolution.
