RESOLUTION AUTHORIZING THE COUNTY TO APPLY FOR SUPPLEMENTAL FUNDING FROM THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION, GREEN ACRES PROGRAM, FOR THE PECKMAN PRESERVE IMPROVEMENT PROJECT, PURSUANT TO N.J.S.A. 40A:20-1, ET SEQ.

WHEREAS, the County of Passaic (“County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), provides grants and/or loans to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition, development, and stewardship of lands for outdoor recreation and conservation purposes; and
WHEREAS, the County has previously obtained a Green Acres grant in the amount of four hundred eighty-two thousand five hundred dollars ($482,500.00) from the State to fund the Peckman Preserve Park Improvements Project in the Township of Little Falls; and
WHEREAS, the County desires to further the public interest by requesting an additional Green Acres loan in the amount of one million eight hundred seventy-five thousand dollars ($1,875,000.00) and a Green Acres grant in the amount of one hundred forty-two thousand five hundred dollars ($142,500.00) from the State to fund the Peckman Preserve Improvement Project, with proposed improvements including a trailhead parking area, a multi-use trailhead structure, a preserve-wide pathway system with mowed and aggregate paths, an elevated boardwalk, an outdoor classroom platform, public art installations, interpretive exhibits, and ecological restoration efforts such as woodland restoration and a managed meadow; and
WHEREAS, the State shall determine if the supplemental funding request is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and
WHEREAS, the County is willing to use the State’s funds in accordance with such rules, regulations, and applicable statutes, and is willing to enter into an agreement with the State for the above-named project; and
WHEREAS, if awarded, the County agrees to provide its matching share to the Green Acres funding request, if any; and
WHEREAS, this matter was discussed at the January 15, 2025 Administration and Finance Committee meeting, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, that the Board of County Commissioners of the County of Passaic hereby declares that Matthew P. Jordan, County Administrator, is hereby authorized to:
1. Apply for Green Acres loan in the amount of one million eight hundred seventy-five thousand dollars ($1,875,000.00) and a Green Acres grant in the amount of one hundred forty-two thousand five hundred dollars ($142,500.00)from the New Jersey Department of Environmental Protection, Green Acres Program for the Peckman Preserve Park Improvements Project in the Township of Little Falls;
2. Provide additional application information and furnish such documents as may be required.
3. Act as the authorized correspondent of the County.
LET IT BE FURTHER RESOLVED, that the County agrees to provide its matching share to the Green Acres funding request, if a match is required.
LET IT BE FURTHER RESOLVED, in the event the State’s funds are less than the total project cost specified above, the applicant has the balance of funding necessary to complete the project.
LET IT BE FURTHER RESOLVED, that the County agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator, Director of Cultural & Historic Affairs, and the Director of the Board are authorized to take any actions necessary to carry out the purpose of this resolution.
LET IT BE FURTHER RESOLVED, that this resolution shall take effect immediately.
